An Act to amend the
Safe Streets Act, 1999
and the Highway Traffic Act
to recognize the fund-raising activities
of registered charities

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  Section 3 of the Safe Streets Act, 1999, as amended by the Statutes of Ontario, 2002, chapter 17, Schedule F, Table, is amended by adding the following subsection:

Permitted fund-raising by charities

(3)  Subsection (2) does not apply to fund-raising activities that meet the following conditions:

1. They are conducted by a charitable organization registered under the Income Tax Act (Canada) on a roadway where the maximum speed limit is 50 kilometres per hour.

2. They are permitted by a by-law of the municipality in which the activities are conducted.

2.  Section 177 of the Highway Traffic Act, as re-enacted by the Statutes of Ontario, 1999, chapter 8, section 7, is amended by adding the following subsection:

Permitted fund-raising by charities

(3.1)  Subsection (2) does not apply to fund-raising activities that meet the following conditions:

1. They are conducted by a charitable organization registered under the Income Tax Act (Canada) on a roadway where the maximum speed limit is 50 kilometres per hour.

2. They are permitted by a by-law of the municipality in which the activities are conducted.

Commencement

3.  This Act comes into force on the day it receives Royal Assent.

Short title

4.  The short title of this Act is the Safe Streets Statute Law Amendment Act, 2005.

EXPLANATORY NOTE

This Explanatory Note was written as a reader's aid to Bill 58 and does not form part of the law. Bill 58 has been enacted as Chapter 32 of the Statutes of Ontario, 2005.

The Bill amends the Safe Streets Act, 1999 to provide that the prohibition in subsection 3 (2) of the Act does not apply to fund-raising activities that are conducted by registered charitable organizations on roadways where the speed limit is not more than 50 kilometres per hour, as long as these activities are permitted by municipal by-laws. A similar amendment is made to section 177 of the Highway Traffic Act.
