An Act to amend the
Highway Traffic Act
with respect to motorcycle
and bicycle helmets

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. Section 104 of the Highway Traffic Act, as amended by the Statutes of Ontario, 1993, chapter 18, section 1, is further amended by adding the following subsection:

Surrender of helmet for inspection

(2.3) Every rider on or operator of a motorcycle, motor assisted bicycle or bicycle shall, upon the demand of a police officer, surrender his or her helmet for reasonable inspection.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the Highway Traffic Amendment Act (Motorcycle and Bicycle Helmets), 2001.

EXPLANATORY NOTE

The Bill amends the Highway Traffic Act to require motorcyclists and bicyclists to surrender their helmets for police inspection on request.
