An Act to amend the Workplace Safety and Insurance Act, 1997

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. Section 25 of the Workplace Safety and Insurance Act, 1997 is amended by adding the following subsection:

Certain volunteers

(3.1) Subsection (3) applies with respect to a member of a municipal volunteer fire brigade or a municipal volunteer ambulance brigade as though the member were an emergency worker.

2. Section 40 of the Act is amended by adding the following subsection:

Certain volunteers

(4.1) Subsection (4) applies with respect to a member of a municipal volunteer fire brigade or a municipal volunteer ambulance brigade as though the member were an emergency worker.

3. Section 41 of the Act is amended by adding the following subsection:

Certain volunteers

(17) Subsection (16) applies with respect to a member of a municipal volunteer fire brigade or a municipal volunteer ambulance brigade as though the member were an emergency worker.

4. Subsection 78 (3) of the Act is repealed and the following substituted:

(3) The statement by a deemed employer of a municipal volunteer fire brigade or a municipal volunteer ambulance brigade must set out the number of members of the brigade and the amount of earnings, fixed by the deemed employer, to be attributed to each member for the purposes of the insurance plan.

Commencement

5. (1) Subject to subsection (2), this Act shall be deemed to have come into force on January 1, 1998.

(2) Section 2 comes into force on the day this Act receives Royal Assent.

Short title

6. The short title of this Act is the Emergency Volunteers Protection Act, 1998.

EXPLANATORY NOTE

The Bill amends the application of certain provisions of the Workplace Safety and Insurance Act, 1997 with respect to members of municipal volunteer fire brigades and municipal volunteer ambulance brigades. In particular, the deemed employer of each member of a municipal volunteer fire brigade or a municipal volunteer ambulance brigade sets the amount to be attributed to the member for the purposes of the insurance plan under the Act without reference to the member's actual employment, if any, as was previously the case.
