An Act to amend the Municipal Act, 2001

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  The Municipal Act, 2001 is amended by adding the following section:

Absentee Landlords

Regulation of absentee landlords

163.1  (1)  Despite any other Act, a municipality may pass by-laws regulating absentee landlords.

Scope of by-laws

(2)  Without limiting the generality of subsection (1), that subsection authorizes a municipality to provide for a system of licences with respect to absentee landlords, and,

(a) to provide for a system to track the absentee landlords; and

(b) despite anything in section 17, to require absentee landlords to post a bond to be used for property upkeep.

Commencement

2.  This Act comes into force on the day it receives Royal Assent.

Short title

3.  The short title of this Act is the Municipal Amendment Act (By-laws re Absentee Landlords), 2006.

EXPLANATORY NOTE

The Bill amends the Municipal Act, 2001 to specify that making by-laws to regulate absentee landlords is within the jurisdiction of a municipality.
