An Act to amend the Dangerous Goods Transportation Act, 1990 to prohibit the transportation of Nuclear Material

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.Section 1 of the Dangerous Goods Transportation Act is amended by adding the following definitions: "

nuclear material" means nuclear material used or intended to be used in, or nuclear waste from, nuclear weapons and includes mixed oxide fuel (Mox); ("matire nuclaire") "

mixed oxide fuel (Mox)" means a mixture of plutonium dioxide and depleted or natural uranium dioxide. ("combustible MOX")

2.Subsection 2 (1) of the Act is amended by striking out ``This'' in the first line and substituting ``Subject to section 3.1, this''.

3.Subsection 2 (2) of the Act is amended by deleting ``The'' at the start of the subsection and substituting ``Except as prohibited under section 3.1, the''.

4.The Act is amended by adding the following section:

3.1 No person shall transport nuclear material within or through the Province.

5.Subsection 4 (1) of the Act is amended by adding ``or 3.1'' immediately after ``3'' in the first line.

Commencement

6.This Act comes into force on the day it receives Royal Assent.

Short title

7.The short title of this Act is the Dangerous Goods Transportation Amendment Act (Nuclear Material), 1999.

EXPLANATORY NOTE

This bill amends the Dangerous Goods Transportation Act by prohibiting the transportation of nuclear material, including mixed oxide fuel (Mox), within or through the Province.
