An Act to regulate the

spreading and storage of

sewage sludge and biosolids

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. The Environmental Protection Act is amended by adding the following section:

Spreading and storage of sewage sludge

27.1 (1) No person shall spread or store sewage sludge or other biosolids unless a certificate of approval or provisional certificate of approval therefore has been issued by the Director and except in accordance with any conditions set out in the certificate.

Conditions

(2) The Director shall make a certificate issued pursuant to subsection (1) subject to such tests being carried out, standards maintained, records kept, and reports submitted as the Director sees fit.

Interpretation

(3) In this section, "

biosolids" includes paper sludge.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the Environmental Protection Amendment Act, 2000.

EXPLANATORY NOTE

The purpose of the Bill is to provide for the regulation of the spreading and storing of sewage sludge and other biosolids. The Bill would require a certificate of approval from the Director before sewage sludge and other biosolids may be stored or spread. A certificate of approval shall be subject to such testing, recording and reporting requirements as the Director sees fit.
