An Act to amend the Income Tax Act with respect to expense allowances earned in Ontario by Members of Parliament and Senators

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. (1) The definition of "income earned in the taxation year in Ontario" in subsection 4 (1) of the Income Tax Act, as re-enacted by the Statutes of Ontario, 1996, chapter 24, section 12, is amended by adding at the end "subject to subsection (1.1)".

(2) Section 4 of the Act, as amended by the Statutes of Ontario, 1992, chapter 25, section 2, 1996, chapter 1, Schedule C, section 4, 1996, chapter 18, section 2, 1996, chapter 24, section 12 and 1997, chapter 10, section 2, is further amended by adding the following subsection:

M.P.s' expense allowances

(1.1) Despite anything in the Federal Act, all amounts earned in a taxation year in Ontario by a member of the Senate or the House of Commons as an allowance for expenses that are paid under section 63 of the Parliament of Canada Act (Canada) shall be included in the member's income earned in the taxation year in Ontario.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the Income Tax Amendment Act (Expense Allowances of Members of Parliament and Senators), 1998.
