An Act to amend the Highway Traffic Act in respect of contravening the rules of the road and causing death

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Part X of the Highway Traffic Act is amended by adding the following section:

Offence, contravention of rules of the road causing death or bodily harm

   191.0.2  Every person who, as a result of contravening any provision of this Part, causes the death of or bodily harm to any person is guilty of an offence and on conviction is liable not to the penalty otherwise provided for that contravention, but to a fine of not less than $1,000 and not more than $10,000 or to imprisonment for a term of not more than six months, or to both.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Highway Traffic Amendment Act, 2011.

 

EXPLANATORY NOTE

The Bill amends the Highway Traffic Act to make it an offence to cause the death of or bodily harm to any person as a result of contravening any rule of the road set out in Part X of the Act.
