An Act to amend the Highway Traffic Act with respect to trailers

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Section 85 of the Highway Traffic Act is amended by adding the following subsections:

Trailers

   (2.1)  Subsection (1) does not apply in respect of a trailer if the gross weight of the trailer is 4,500 kilograms or less.

Same

   (2.2)  For the purposes of subsection (2.1), the gross weight of a trailer does not include the weight of any motor vehicle that draws the trailer.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Highway Traffic Amendment Act (Trailers), 2016.

 

EXPLANATORY NOTE

Currently, section 85 of the Highway Traffic Act requires vehicles to display evidence of compliance with certain inspection requirements and performance standards if the vehicle is prescribed by a regulation. Regulation 611 (Safety Inspections) of the Revised Regulations of Ontario, 1990 makes the requirement in section 85 of the Act applicable to a commercial motor vehicle if the combined gross weight of the vehicle and any trailer it draws exceeds 4,500 kilograms and to certain types of recreational vehicles, motor homes and house trailers.

The Bill amends the Act to provide that compliance is not required for trailers with a gross weight, not including the motor vehicle, of 4,500 kilograms or less.
