An Act to amend the Highway Traffic Act to require vehicles driven by drivers over the age of 80 to display markers or identifying devices

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  The Highway Traffic Act is amended by adding the following sections:

Signage requirements, drivers over 80

   13.1  (1)  No person who is over the age of 80 shall drive a motor vehicle on a highway unless markers or identifying devices indicating that the vehicle is being driven by a person who is over the age of 80 are displayed on or in the vehicle in accordance with subsection (2).

   (2)  Unless otherwise specified by regulation, the markers or identifying devices must depict "80+" in red and must be prominently displayed and clearly visible from the front and rear of the motor vehicle.

Offence

   (3)  Every person who contravenes this section is guilty of an offence and on conviction is liable to a fine of not less than $100 and not more than $250.

Regulations, drivers over 80

   13.2  The Lieutenant Governor in Council may make regulations in respect of drivers who are over the age of 80.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Drivers Over the Age of 80 Identification Act, 2011.

 

EXPLANATORY NOTE

The Bill amends the Highway Traffic Act to prohibit drivers who are over the age of 80 from driving a motor vehicle on a highway unless markers or identifying devices indicating that the motor vehicle is being driven by a driver who is over the age of 80 are displayed on or in the vehicle.  Unless otherwise specified by regulation, the markers or identifying devices must depict "80+" in red and must be prominently displayed and clearly visible from the front and rear of the motor vehicle.
