An Act to amend The Welland-Port Colborne Airport Act, 1976

Preamble

The Niagara Central Airport Commission has applied for special legislation to ratify an agreement changing the name of the Niagara Central Airport to the Niagara Central Dorothy Rungeling Airport.

The Commission was established under the name the Welland-Port Colborne Airport Commission by an agreement dated January 1, 1969 for the purpose of establishing, operating and maintaining the Welland-Port Colborne Airport and was continued under an agreement dated January 1, 1974, which was ratified in The Welland-Port Colborne Airport Act, 1976.

The Welland-Port Colborne Airport Commission changed its name to the Niagara Central Airport Commission and changed the name of the Welland-Port Colborne Airport to the Niagara Central Airport in an agreement dated February 13, 2001, which was ratified in the Niagara Central Airport Commission Act, 2001.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. Section 1 of The Welland-Port Colborne Airport Act, 1976 is repealed and the following substituted:

Definitions

1. In this Act,

"Airport" means,

(a) before June 29, 2001, the Welland-Port Colborne Airport,

(b) on and after June 29, 2001 until the Niagara Central Dorothy Rungeling Airport Act, 2015 receives Royal Assent, the Niagara Central Airport, and

(c) after the Niagara Central Dorothy Rungeling Airport Act, 2015 receives Royal Assent, the Niagara Central Dorothy Rungeling Airport;

"Commission" means,

(a) before June 29, 2001, the Welland-Port Colborne Airport Commission,

(b) on and after June 29, 2001, the Niagara Central Airport Commission.

2. The Act is amended by adding the following section:

Agreement re airport name change, 2015

2.2 (1) On the day the Niagara Central Dorothy Rungeling Airport Act, 2015 receives Royal Assent, the agreement dated March 10, 2015 between The Corporation of the City of Welland, The Corporation of the City of Port Colborne, The Corporation of the Town of Pelham and The Corporation of the Township of Wainfleet respecting the change of the name of the Niagara Central Airport is hereby ratified and confirmed and declared to be valid and binding upon the parties to the agreement and their successors.

(2) Under the agreement referred to in subsection (1),

(a) the name of the Niagara Central Airport is changed to the Niagara Central Dorothy Rungeling Airport; and

(b) all other terms and conditions of the agreements referred to in subsection (3), except with respect to the name of the Airport, remain the same and in full force and effect.

Agreements

(3) The agreements referred to in clause (2) (b) are the following:

1. The agreement dated January 1, 1969 that established the Commission and that was continued under the agreement dated January 1, 1974, referred to in subsection 2 (1).

2. The agreement dated January 1, 1974, referred to in subsection 2 (1).

3. The agreement dated February 13, 2001, referred to in subsection 2.1 (1).

Commencement

3. This Act comes into force on the day it receives Royal Assent.

Short title

4. The short title of this Act is the Niagara Central Dorothy Rungeling Airport Act, 2015.
