An Act respecting the Ontario Institute of the Purchasing Management Association of Canada Inc.

Preamble

The Ontario Institute of the Purchasing Management Association of Canada Inc. has applied for special legislation to grant to its members the right to use the designations "Certified Supply Chain Management Professional" and "CSCMP" in addition to the designations "Certified Professional Purchaser" and "C.P.P.".  The applicant was continued as a corporation without share capital under the Ontario Institute of the Purchasing Management Association of Canada Inc. Act, 1987, under which its members were granted the right to use the designations "Certified Professional Purchaser" and "C.P.P.".

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Section 8 of the Ontario Institute of the Purchasing Management Association of Canada Inc. Act, 1987 is repealed and the following substituted:

Designations

   8.  (1)  Every registered member of the Institute may use the designation "Certified Professional Purchaser" or "Certified Supply Chain Management Professional", or both, or the initials "C.P.P." or "CSCMP", or both, and may use a seal in a form provided by the by-laws.

Offence

   (2)  Any person in Ontario who, not being a registered member of the Institute, takes or uses the designation "Certified Professional Purchaser", "C.P.P.", "Certified Supply Chain Management Professional" or "CSCMP", alone or in combination with any other word, name, initial, title or description or implies, suggests or holds out that he or she is a registered member of the Institute is guilty of an offence.

Evidence

   8.1  (1)  A copy of the register, certified by the registrar as a true copy, shall be received in evidence in any proceeding as proof, in the absence of evidence to the contrary, of a person's registered membership in the Institute.

   (2)  A certificate purporting to be signed by the registrar is proof, in the absence of evidence to the contrary, that such person is the registrar without any proof of the person's signature or of the person being in fact the registrar.

   (3)  The absence of the name of any person from a copy of the register produced under subsection (1) is proof, in the absence of evidence to the contrary, that the person is not a registered member of the Institute.

   2.  Section 10 of the Act is repealed and the following substituted:

Right to practise not affected

   10.  This Act does not affect or interfere with the right of any person who is not a registered member of the Institute to practise as a professional purchaser or supply chain management professional in Ontario.

Commencement

   3.  This Act comes into force on the day it receives Royal Assent.

Short title

   4.  The short title of this Act is the Ontario Institute of the Purchasing Management Association of Canada Inc. Act, 2010.
