An Act respecting Thunder Bay International Airports Authority Inc.

Preamble

The Thunder Bay International Airports Authority Inc. has applied for special legislation respecting the authority of The Corporation of the City of Thunder Bay to make grants or loans under subsections 28 (7) and (7.1) of the Planning Act in connection with aerospace activity on certain airport lands. The applicant represents that it was incorporated on August 3, 1995 by letters patent issued under the Canada Corporations Act and that it is a non-profit corporation. The applicant further represents that it leases the applicable airport lands from the Crown in right of Canada and that the lease expires on October 31, 2057.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Definitions

1.  In this Act,

"aerospace activity" means an activity related to the designing, engineering, manufacturing, movement, storage or maintenance of aerospace equipment or of components of such equipment;

"designated airport lands" means the following property as described on plans registered with the Land Titles Office in the City of Thunder Bay:

1. PIN 62017-0035 being Parts 1, 2 and 3 on Plan 55R-9669.

2. PIN 62019-0087 being Parts 1 and 2 on Plan 55R-7732, Part 1 on Plan 55R-8147, Part 1 on Plan 55R-8148 and Part 1 on Plan 55R-8834.

3. PINs 62019-0248 and 62019-0283 being Part 2 on Plan 55R-8148.

4. PINs 62019-0261 and 62019-0262 being Part 2 on Plan 55R-8147.

5. PIN 62268-0496 being Part 1 on Plan 55R-8149;

"improvement" means any alteration, addition or repair to, or any construction, erection or installation on, any land and includes the demolition or removal of any building, structure or works or part thereof, but does not include buildings, structures or fixtures which merely rest on the land and which could be removed at will without changing the character of the land itself.

Grants or loans re aerospace activity

2.  (1)  This section applies if all or part of the designated airport lands constitute the community improvement project area under a community improvement plan that is in effect under section 28 of the Planning Act.

(2)  The following matters are deemed to constitute the rehabilitation of land and buildings within the community improvement project area described in subsection (1) for the purpose of authorizing the City of Thunder Bay to make grants or loans under subsection 28 (7) of the Planning Act and for the purpose of subsection 28 (7.1) of that Act:

1. The introduction of any development with a primary focus on aerospace activity within the community improvement project area.

2. The expansion or improvement of any development with a primary focus on aerospace activity within the community improvement project area.

Commencement

3.  This Act comes into force on the day it receives Royal Assent.

Short title

4.  The short title of this Act is the Thunder Bay International Airports Authority Inc. Act, 2006.
