An Act respecting
the Town of Erin

Preamble

The Corporation of the Town of Erin has applied for special legislation to continue in force all current by-laws, resolutions and official plans of the former Township of Erin and the former Village of Erin until they are repealed. The applicant represents that it was created on January 1, 1998 by a restructuring order made under section 25.2 of the Municipal Act that amalgamated The Corporation of the Township of Erin and The Corporation of the Village of Erin and that the restructuring order provides that all by-laws, resolutions and official plans of the former municipalities cease to be in force on December 31, 2002.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Definitions

1. In this Act,

"former municipality" means The Corporation of the Township of Erin or The Corporation of the Village of Erin, as they existed on December 31, 1997;

"municipality" means The Corporation of the Town of Erin;

"restructuring order" means the order amalgamating the former municipalities into the municipality, effective on January 1, 1998, that was made on June 12, 1997 by the Minister of Municipal Affairs and Housing under section 25.2 of the Municipal Act, as the order appears in The Ontario Gazette dated June 28, 1997.

By-laws, resolutions,
official plans of former municipalities continued

2. (1) A by-law, resolution or official plan of a former municipality that is in force on the day this Act receives Royal Assent remains in force until it is repealed by the municipality.

(2) Subsection (1) applies despite subsections 6 (1) and (2) of the restructuring order and subsection 25.2 (12) of the Municipal Act.

Commencement

3. This Act comes into force on the day it receives Royal Assent.

Short title

4. The short title of this Act is the Town of Erin Act, 2002.
