Government Notice of Motion Number 86

Avis de motion numéro 86 émanant du Gouvernement

Mr. Bryant – That the Standing Orders as amended on May 1, 2008 be further amended as follows and adopted as the permanent Standing Orders of the House; and

That the permanent Standing Orders come into force at 12:01 a.m. on the Friday of the week that they are adopted by the House, except Standing Order 6(a) which shall come into force at 12:01 a.m. on January 1, 2009. Standing Order 6(a) as it existed immediately prior to the coming into force of the permanent Standing Orders shall remain in effect until 12:01 a.m. on January 1, 2009.

That the definition of "Routine Motion" in Standing Order 2 be amended by striking out "9" in the second line and substituting "6".

That Standing Order 6(a) be struck out and the following substituted:-

6.(a)  During a Parliament, the House shall meet:

(i) from the third Tuesday in February to the first Thursday in June; and

(ii) from the Monday following Labour Day to the second Thursday in December.

During these meeting periods, the House shall not meet during the following Constituency Weeks:

1. The week prescribed by the Regulations made under the Education Act for the school holiday in March;

2. The week in which Easter Monday falls;

3. The week in which Victoria Day falls;

4. The week in which Thanksgiving Day falls;

5. The week in which Remembrance Day falls, except that if Remembrance Day falls on a Saturday or a Sunday, the House shall instead not meet the week preceding Remembrance Day.

That clauses (a) and (b) of Standing Order 8 be struck out and the following substituted:-

8.(a)  The weekly meeting schedule for the House when it is in session shall be:

(b) The bells shall be rung for five minutes before the time appointed for the meeting of the House, and at 10:25 a.m. every day, to summon the members, and otherwise at the discretion of the Speaker.

That Standing Order 8 be amended by adding the following new clauses:-

(c.1) During any morning that the House meets, when the Speaker calls "Orders of the Day" the Government House Leader may indicate that no business, or no further business, as the case may be, is to be called that morning, whereupon the Speaker shall without motion immediately recess the House until 10:30 a.m.

(c.2) No later than 3:15 p.m. on any Monday, Tuesday or Wednesday that the House meets, the Government House Leader may indicate that no business is to be called during Orders of the Day on the next day's morning meeting, and in such case the House shall meet at 10:30 a.m. on that next day.

That clause (d) of Standing Order 8 be amended by striking out the words "during the week prescribed by the Regulations made under the Education Act for the school holiday in March" in the first, second and third lines and substituting "on the day on which there is a general election of members to serve in the Canadian House of Commons".

That Standing Order 9(b) be struck out.

That clause (d) of Standing Order 9 be amended by striking out the word "Routine" in the fourth line.

That clause (h) of Standing Order 28 be amended by striking out the word "Routine" in the sixth line.

That clause (a) of Standing Order 30 be amended by striking out "Deferred Votes" and substituting "Petitions".

That clause (b) of Standing Order 30 be amended by striking out "Petitions" and substituting "Deferred Votes".

That clause (c) of Standing Order 30 be amended by striking out "and any deferred votes," in the fifth line.

That clause (c) of Standing Order 32 be amended by striking out "notwithstanding Standing Order 46(a)" in the fourth and fifth lines.

That Standing Order 36 be struck out and the following substituted:-

36. Up to five minutes shall be allotted, immediately preceding "Oral Questions" and again immediately upon the resumption of the House in an afternoon meeting, for members to recognize guests.

That clause (a) of Standing Order 38 be amended by striking out "4:30 p.m." and "5:00 p.m." in the ninth line and substituting "noon" and "4:00 p.m.", respectively.

That clause (b) of Standing Order 38 be amended by striking out "5:45 p.m." in the second line and substituting "6:00 p.m.", and by adding at the end of the clause "or, pursuant to Standing Order 6(c)(i) or (ii), to 6:45 p.m., as the case may be."

That clause (e) of Standing Order 38 be amended by striking out "5:45" and substituting "6:00".

That clause (b) of Standing Order 39 be amended by adding the word "Routine" before the word "Proceeding" in the second line.

That clause (c) of Standing Order 43 be amended by striking out "5:35" in the second line and substituting "5:50".

That clause (b) of Standing Order 44 be amended by striking out "5:35" in the fifth line and substituting "5:50".

That Standing Order 46(a) be amended by adding the following sentence:-

If at 10:15 a.m. on a Tuesday, Wednesday or Thursday the division bells are ringing for a vote on a motion to adjourn the debate, the Speaker shall interrupt the bell, conduct the division and then immediately recess the House pursuant to Standing Order 8(a).

That clause (b) of Standing Order 58 be struck out and the following substituted:-

(b) On the day designated for the presentation of the Budget, the Speaker shall recess the House immediately following Routine Proceedings until 4:00 p.m., except that if Routine Proceedings have not been completed by 4:00 p.m., the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of the Routine Proceeding currently occupying the House and immediately call Orders of the Day.

That the following new Standing Order be added:-

68.1 (a) Private Members' Public Bills may be co-sponsored by up to one member from each of the recognized parties, and by any independent member. It shall be the responsibility of the co-sponsors to select which among them will move the motion for introduction and first reading of the bill. Any of the co-sponsors shall be entitled to move the motions for second or third reading of the bill. The names of the co-sponsors shall be indicated on the introduction copy of the bill and shall thereafter be printed on the face of the bill.

(b) Any one of the co-sponsors of such a bill may designate the bill as his or her item of business for Private Members' Public Business, and any or all of the co-sponsors may speak during the time allotted by Standing Order 97(a)(i). The member designating the bill for the purposes of Private Members' Public Business shall have charge of the bill in any committee.

(c) A co-sponsor may withdraw as a sponsor of the bill at any time by providing written notice to the Clerk of the House. His or her name shall be removed from the bill entry on the Orders and Notices Paper, and shall be removed from the face of the bill at any subsequent re-printing of the bill.

That clause (e) of Standing Order 125 be deleted and the following substituted:

(e) There shall be not less than three hours of debate in the House on such a bill, to take place at a time or times allotted by agreement of the House Leaders of the recognized Parties.

That the Clerk of the House be authorized and instructed to print a revised edition of the Standing Orders of the House, renumbering and making such technical and consequential changes as may be deemed necessary.

Mr. Delaney – That, in the opinion of this House, the Legislative Assembly of Ontario should request of the Government of Canada that an amendment be made to the terms of reference governing the Canadian Radio-television and Telecommunications Commission (CRTC) to ensure that a condition to the CRTC's granting, or renewal, of a license to carry cable, wireless, wireless cable or any other type of television content by every distributor in any market is the requirement to broadcast, as part of every basic package of television services or channels, and using a minimum of one dedicated channel, the legislative proceedings of the province or territory in which the distributor of the television content proposes to offer service, as supplied to the distributor by the legislative broadcast service in that province or territory.

–    ability of the enforcing authority to impose fines for breach of compliance;

–    ability of the enforcing authority to track and maintain safety standards during a change of ownership;

–    review of training procedures for the storage, handling and transportation of volatile fuels;

–    monitoring of administrative procedures and requirements, including adequate insurance coverage sufficient to deal with clean ups and damage to neighbouring properties;

–    role of municipalities and fire services in site location, emergency planning and identification of hazardous sites;

–    transparency of inspection results and public notification of non-compliant sites;

–    review of frequency of inspections and reporting requirements;

–    institution of buffer zones and regulatory framework for the transition of new rules for existing sites.

86. Mr. Bryant – That the Standing Orders as amended on May 1, 2008 be further amended as follows and adopted as the permanent Standing Orders of the House; and

That the permanent Standing Orders come into force at 12:01 a.m. on the Friday of the week that they are adopted by the House, except Standing Order 6(a) which shall come into force at 12:01 a.m. on January 1, 2009. Standing Order 6(a) as it existed immediately prior to the coming into force of the permanent Standing Orders shall remain in effect until 12:01 a.m. on January 1, 2009.

That the definition of "Routine Motion" in Standing Order 2 be amended by striking out "9" in the second line and substituting "6".

That Standing Order 6(a) be struck out and the following substituted:-

6.(a)  During a Parliament, the House shall meet:

(i) from the third Tuesday in February to the first Thursday in June; and

(ii) from the Monday following Labour Day to the second Thursday in December.

(b) The bells shall be rung for five minutes before the time appointed for the meeting of the House, and at 10:25 a.m. every day, to summon the members, and otherwise at the discretion of the Speaker.

That Standing Order 8 be amended by adding the following new clauses:-

(c.1) During any morning that the House meets, when the Speaker calls "Orders of the Day" the Government House Leader may indicate that no business, or no further business, as the case may be, is to be called that morning, whereupon the Speaker shall without motion immediately recess the House until 10:30 a.m.

(c.2) No later than 3:15 p.m. on any Monday, Tuesday or Wednesday that the House meets, the Government House Leader may indicate that no business is to be called during Orders of the Day on the next day's morning meeting, and in such case the House shall meet at 10:30 a.m. on that next day.

That clause (d) of Standing Order 8 be amended by striking out the words "during the week prescribed by the Regulations made under the Education Act for the school holiday in March" in the first, second and third lines and substituting "on the day on which there is a general election of members to serve in the Canadian House of Commons".

That Standing Order 9(b) be struck out.

That clause (d) of Standing Order 9 be amended by striking out the word "Routine" in the fourth line.

If at 10:15 a.m. on a Tuesday, Wednesday or Thursday the division bells are ringing for a vote on a motion to adjourn the debate, the Speaker shall interrupt the bell, conduct the division and then immediately recess the House pursuant to Standing Order 8(a).

That clause (b) of Standing Order 58 be struck out and the following substituted:-

(b) On the day designated for the presentation of the Budget, the Speaker shall recess the House immediately following Routine Proceedings until 4:00 p.m., except that if Routine Proceedings have not been completed by 4:00 p.m., the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of the Routine Proceeding currently occupying the House and immediately call Orders of the Day.

That the following new Standing Order be added:-

68.1 (a) Private Members' Public Bills may be co-sponsored by up to one member from each of the recognized parties, and by any independent member. It shall be the responsibility of the co-sponsors to select which among them will move the motion for introduction and first reading of the bill. Any of the co-sponsors shall be entitled to move the motions for second or third reading of the bill. The names of the co-sponsors shall be indicated on the introduction copy of the bill and shall thereafter be printed on the face of the bill.

(b) Any one of the co-sponsors of such a bill may designate the bill as his or her item of business for Private Members' Public Business, and any or all of the co-sponsors may speak during the time allotted by Standing Order 97(a)(i). The member designating the bill for the purposes of Private Members' Public Business shall have charge of the bill in any committee.

(c) A co-sponsor may withdraw as a sponsor of the bill at any time by providing written notice to the Clerk of the House. His or her name shall be removed from the bill entry on the Orders and Notices Paper, and shall be removed from the face of the bill at any subsequent re-printing of the bill.

That clause (e) of Standing Order 125 be deleted and the following substituted:

(e) There shall be not less than three hours of debate in the House on such a bill, to take place at a time or times allotted by agreement of the House Leaders of the recognized Parties.

Mrs. Witmer – Whereas, the McGuinty government is unwilling to acknowledge the severity of the deadly outbreak of C. difficile in Ontario, in spite of 300 known deaths in only 7 hospitals which have reported to date; and

Whereas, the McGuinty government has ignored a recommendation from the Canadian Medical Association to take immediate action on C. difficile, in light of deaths related to C. difficile several years ago in Quebec; and

Whereas, the McGuinty government, despite repeated calls by the Official Opposition, has failed to appoint an independent investigator to look into the tragic and preventable deaths caused by C. difficile in Ontario and has also refused to allow the Ombudsman to investigate the outbreak; and

Whereas, the McGuinty government, despite repeated calls by the Official Opposition, has failed to call a public inquiry, so that the public would know why these preventable deaths occurred and steps could be taken to prevent further deaths related to C. difficile in hospitals throughout Ontario; and

Whereas, the McGuinty government has failed to reassure the public by providing a comprehensive plan to combat C. difficile, putting the public at further risk of contracting C. difficile in Ontario hospitals; The government no longer has the confidence of this House. Filed on June 18, 2008.

8.         Mr. Wilson – That, in the opinion of this House, the Government of Ontario should support the Town of New Tecumseth and the Sir Frederick Banting Legacy Foundation by ensuring that the recommendations made by the Conservation Review Board on the future of the Sir Frederick Banting Homestead in Alliston are enacted and that the Government of Ontario should take every measure necessary to ensure that this property is transferred to either the Town of New Tecumseth or the Sir Frederick Banting Legacy Foundation for the purpose of creating an educational and interpretative centre on a not-for-profit basis, such as a camp for diabetic youth, and to ensure that the property is properly maintained. 9.         Mr. Barrett – That, in the opinion of this House, the following Order of Reference should be assigned to an all-Party committee of the Legislative Assembly:

11.       Mr. Yakabuski – That, in the opinion of this House, the Government of Ontario should introduce legislation to exempt members of the Canadian Armed Forces from liability to pay the tax known as the Ontario Health Premium and that the Government immediately discontinue charging those members for that tax. 12.       Ms. DiNovo – That, in the opinion of this House, the Ontario Government should support the Federal motion to urge the government of the People's Republic of China and representatives of Tibet's government in exile, to continue their dialogue in a forward looking manner that will lead to pragmatic solutions that respect the Chinese constitutional framework, the territorial integrity of China and fulfill the aspirations of the Tibetan people for a unified and genuinely autonomous Tibet. 13.       Ms. DiNovo – That, in the opinion of this House, the Government of Ontario should immediately commence construction of not-for-profit rent geared to income housing units in order to keep its election promise of building 26,600 units; and begin to meet the housing needs of the 125,000 Ontarians on the waiting lists for affordable housing. 14.       Ms. DiNovo – That, in the opinion of this House, the Government of Ontario should immediately end the clawback of the National Child Benefit Supplement from all families in Ontario. Filed on March 17, 2008.

15.       Ms. DiNovo – That, in the opinion of this House, the powers of the Ontario Municipal Board be amended so that they are not able to undermine the authority of democratically elected city councils in decisions such as land use planning and others. Filed on March 17, 2008.

16.       Ms. DiNovo – That, in the opinion of this House, seniors 65 years of age or over, have free access to Ontario funded art galleries and museums, and that the Ontario government reimburse these galleries and museums to compensate for the drop of revenue in providing this free access. 18.       Ms. DiNovo – That, in the opinion of this House, 25% of all Ontario places of employment be inspected each year.  Filed on March 17, 2008.

19.       Ms. Horwath – That, in the opinion of this House, the Government of Ontario should:

a)   Proclaim a regulation that implements an immediate temporary moratorium on issuing or renewing licences to operate Child Care Centres due to the potential consequences brought to light by present plans to acquire and consolidate ownership of existing for-profit operators;

b)   Order a full policy review of child care in Ontario to ensure that future expansion only occurs in the not-for-profit sector upon ending the moratorium. Filed on March 17, 2008.

21.       Mr. Wilson – That, in the opinion of this House, due to the potato industry in Ontario being subjected to the worst drought on record in 2007, affecting 30,000 out of 37,000 acres designated for potato growth, yielding the worst potato crop on record and presenting potato growers with huge losses, the Government of Ontario should instruct the Ministry of Agriculture to provide an ad hoc payment of $12.8 million to the potato farmers of Ontario for relief from the drought of 2007. 26.       Ms. MacLeod – That, in the opinion of this House, the Legislative Assembly should televise its proceedings online at www.ontla.on.ca; should make arrangements to have Bell Canada (including Satellite) televise proceedings (as Rogers Cable does) as part of their basic package; and should arrange with provincially funded cable stations TVO and TFO that daily Question Period is televised, in order to provide all residents of Ontario, particularly those in rural Ontario who do not have access to other cable sources, with access to the daily proceedings at Queen's Park. 27.       Ms. Jones – That, in the opinion of this House, the Government of Ontario should immediately expand the Foodland Ontario program to include a designation for organically grown products and expand their Foodland Ontario logo to include the word "organic" where appropriate. Filed on

31.       Ms. Horwath – That, in the opinion of this House, the Government of Ontario should order a stand-alone inquest into the March 2006 murder of eight-year old Jared Osidacz, using the powers vested in the Minister of Community Safety and Correctional Services under Section 22 of The Coroners Act. 32.       Ms. Horwath – That, in the opinion of this House, the Government of Ontario should designate children's mental health as a mandated provincial program to ensure adequate, stable and sustainable funding for the sector and the valued services it provides to Ontario's children and youth. 34.       Ms. Horwath – That, in the opinion of this House, the Government of Ontario should proclaim the first full week from Monday to Sunday in May of each year as Children's Mental Health Week. Filed on May 5, 2008.

35.       Mrs. Witmer – That, in the opinion of this House, all Ontarians deserve to have timely access to a family doctor and that the Government of Ontario must take all steps possible to recruit new doctors to the province and retain those currently practicing here by making Ontario a more attractive place to practice medicine. 36.       Mr. Tabuns – That, in the opinion of this House, federal immigration legislation (Bill C-50) will have significant consequences for many families residing in this province, will substantially change current immigration legislation without proper consultation and will introduce substantial arbitrary elements into the administration of immigration processing, and should therefore be defeated by all parties in the Parliament of Canada. 38.       Mr. Hillier – That, in the opinion of this House, in order to achieve an equitable, fair and stable provincial-municipal funding arrangement, a provincial-municipal funding Act and financing formula should be adopted, to provide long-term predictable and sustainable funding that allows our municipal partners the ability to provide the required services to their residents. 39.       Mr. Hillier – That, in the opinion of this House, the Business Education Tax be either eliminated or set at the same rate throughout Ontario to prevent the Ontario government from favouring the economic development of some municipalities at the expense of other Ontario municipalities by using differential business tax rates. 41.       Ms. Horwath  – That, in the opinion of this House, the Government of Ontario should instruct all Children's Aid Societies to publish information electronically on their websites, where available, and in print format, readily accessible in the lobby area of each CAS office, which informs the public of their ability to attend and make presentations at the regularly scheduled Board of Director's meetings, the schedule and Minutes of those meetings, and further, in the same manner as mentioned above, to inform the public of the fact that CAS memberships are available to people who reside in, or who conduct business within the jurisdiction of each CAS, to provide details on how to apply for membership, and to provide access to the Society's By-Laws in the same manner. 44.       Mr. Delaney – That, in the opinion of this House, the Legislative Assembly of Ontario should request of the Government of Canada that an amendment be made to the terms of reference governing the Canadian Radio-television and Telecommunications Commission (CRTC) to ensure that a condition to the CRTC's granting, or renewal, of a license to carry cable, wireless, wireless cable or any other type of television content by every distributor in any market is the requirement to broadcast, as part of every basic package of television services or channels, and using a minimum of one dedicated channel, the legislative proceedings of the province or territory in which the distributor of the television content proposes to offer service, as supplied to the distributor by the legislative broadcast service in that province or territory. –    review of training procedures for the storage, handling and transportation of volatile fuels;

–    monitoring of administrative procedures and requirements, including adequate insurance coverage sufficient to deal with clean ups and damage to neighbouring properties;

–    role of municipalities and fire services in site location, emergency planning and identification of hazardous sites;

–    transparency of inspection results and public notification of non-compliant sites;

–    review of frequency of inspections and reporting requirements;
