Government Notice of Motion Number 70

Avis de motion numéro 70 émanant du gouvernement

Mr. Sterling - Resolution - That pursuant to Standing Order 46 and notwithstanding any other Standing Order or the Order of the House dated May 30, 2000 relating to Bill 69, An Act to amend the Labour Relations Act, 1995 in relation to the construction industry, the Order for third reading be discharged and that the bill be recommitted to the Standing Committee on Justice and Social Policy;

That, pursuant to Standing Order 75(c), the Chair of the Standing Committee on Justice and Social Policy shall establish a deadline for the filing of amendments with the Clerk of the Committee; and

That the Standing Committee on Justice and Social Policy shall be authorized to meet November 16, 2000 for clause-by-clause consideration of the bill; and

That the Committee be authorized to meet beyond its normal hour of adjournment on that day until completion of clause-by-clause consideration; and

That, at 4:30 p.m. on the day designated for clause-by-clause consideration of the bill, those amendments which have not been moved shall be deemed to have been moved, and the Chair of the Committee shall interrupt the proceedings and shall, without further debate or amendment, put every question necessary to dispose of all remaining sections of the bill, and any amendments thereto. Any division required shall be deferred until all remaining questions have been put and taken in succession with one 20-minute waiting period allowed pursuant to Standing Order 127(a); and

That the Committee shall report the bill to the House not later than the first Sessional day that reports from Committees may be received following the completion of clause-by-clause consideration, and not later than November 20, 2000. In the event that the committee fails to report the bill on the date provided, the bill shall be deemed to have been passed by the Committee and shall be deemed to be reported to and received by the House;

That upon receiving the report of the Standing Committee on Justice and Social Policy, the Speaker shall put the question for adoption of the report forthwith, and at such time the bill shall be ordered for third reading;

That, when the Order for Third Reading is called, one Sessional day shall be allotted to the third reading stage of the bill, at the end of which time the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of the bill without further debate or amendment;

That, the vote on third reading may, pursuant to Standing Order 28(h), be deferred until the next Sessional day during the Routine Proceeding "Deferred Votes"; and

That, in the case of any division relating to any proceedings on the bill, the division bell shall be limited to five minutes.

c) knows that the use of illegal drugs compromises the ability of offenders to successfully complete treatment programs to overcome their addictions;

d) supports action to eliminate the use of illegal drugs in correctional institutions;

e) introduces regular and random drug tests of all sentenced, remand and intermittent offenders in Ontario's correctional facilities.

Mr. Sterling - Resolution - That, in the opinion of this House, in response to the nearly $30 billion Employment Insurance surplus and to prevent the payroll tax increase currently scheduled for January 1, 2000, the Federal Government must create jobs by reducing job-killing payroll taxes, including the introduction of a significant cut to EI premiums to at least $2 per $100 of insurable earnings. Mr. Eves - Resolution - That the Standing Committee on the Legislative Assembly undertake to review the Freedom of Information and Protection of Privacy Act and report its recommendations back to the House. Filed on May 16, 2000.

Mr. Sterling - Resolution - That the Legislative Assembly of the Province of Ontario,

· Reminds the Government of Canada of the 1998 report prepared for federal, provincial, and territorial ministers of justice, which says that over a 25-year period an estimated 704 sex offenders pardoned by the federal government went on to commit new sex offences, including an estimated 458 sex offences against children;

· Expresses disappointment that the federal government has been sitting on this report for nearly two years while still granting pardons to convicted sex offenders;

· Reminds the federal government that by allowing convicted sex offenders to hide their criminal backgrounds these federal pardons possibly give the offenders easier access to new victims; and

· Demands that the Government of Canada stop granting pardons to convicted pedophiles and other sex offenders. Filed on June 12, 2000.

Mr. Sterling - Resolution - That pursuant to Standing Order 46 and notwithstanding any other Standing Order or the Order of the House dated May 30, 2000 relating to Bill 69, An Act to amend the Labour Relations Act, 1995 in relation to the construction industry, the Order for third reading be discharged and that the bill be recommitted to the Standing Committee on Justice and Social Policy;

 

That, pursuant to Standing Order 75(c), the Chair of the Standing Committee on Justice and Social Policy shall establish a deadline for the filing of amendments with the Clerk of the Committee; and

 

That the Standing Committee on Justice and Social Policy shall be authorized to meet November 16, 2000 for clause-by-clause consideration of the bill; and

 

That the Committee be authorized to meet beyond its normal hour of adjournment on that day until completion of clause-by-clause consideration; and

 

That, at 4:30 p.m. on the day designated for clause-by-clause consideration of the bill, those amendments which have not been moved shall be deemed to have been moved, and the Chair of the Committee shall interrupt the proceedings and shall, without further debate or amendment, put every question necessary to dispose of all remaining sections of the bill, and any amendments thereto. Any division required shall be deferred until all remaining questions have been put and taken in succession with one 20-minute waiting period allowed pursuant to Standing Order 127(a); and

Mr. Hampton - Resolution - That this House express its concern for the increasing number of Ontario children living in poverty and seek to achieve the goal of eliminating poverty among Ontario children by adopting the recommendations of Ontario Campaign 2000. Filed on December 1, 1999.

Mr. Hampton - Resolution - Be it resolved that,

1) this Assembly deplores the continuing violations of human rights in Burma, including extrajudicial and arbitrary executions, rape, torture, inhumane treatment, mass arrests, forced labour, forced relocation, and denial of freedom of expression, assembly, association, and movement, as reported by the UN Human Rights Special Rapporteur.

2) these human rights abuses in Burma are the result of policy at the highest level and the
regime's officials bear political and legal responsibility for them.

 

3) this Assembly urges the military regime in Burma to:

a) immediately and unconditionally release all detained political leaders and political prisoners, to ensure their physical integrity and to permit them to participate in the process of national reconciliation;

b) repeal all regressive laws;

 

c) stop all the violations of human rights and in particular the unlawful coercion against the National League for Democracy (NLD) members leading to surrendering of their membership and the closure of NLD offices; and

d) immediately initiate a substantive political dialogue with the Committee Representing the People's Parliament before there is further violent upheaval in Burma.

 

4) this Assembly condemns the State Peace and Development Council (formerly named the State Law and Order Restoration Council) for:

a) openly encouraging the production, trade and export of opium and heroin into North America; and

b) racially-motivated genocide against the ethnic peoples in Burma, especially those in Karen, Karenni and Shan States; and

 

5) this Assembly urges the Government of Canada to:

a) recognize as the legitimate instrument of the will of the Burmese people the Committee Representing the People's Parliament formed by the National League for Democracy on 15 September 1998 as acquiring the legal authority of 251 MPs and support of the four non-Burman ethnic political parties;

b) take all necessary action to achieve coordinated international action in support of the restoration of human rights in Burma;

c) appeal to the UN Secretary-General to send a special envoy to Burma to continue discussions with the leaders of the military regime as well as with Daw Aung San Suu Kyi and other leaders in order to make significant advances towards the democratization of Burma. Filed on December 15, 1999.

Ms. Churley - Resolution - That, in the opinion of this House, the General Government Committee reconvene to re-open consideration of the appointment of the Environmental Commissioner, and that, in arriving at its decision, the committee consider the policies of the Office, including Section 7.2 and 7.3 of the Policies and Procedures Manual of the Environmental Commissioner of Ontario which read as follows:

"The high conflict of interest threshold is more stringent for the Offices of the Provincial Legislature, such as the Environmental Commissioner, which performs an independent review of the provincial government."

 

"ECO employees must not participate in activities that might identify them as members or supporters of a political party."

Mr. McGuinty - Resolution - That, in the opinion of this House, the current levels of health care funding provided by both the federal and provincial governments are insufficient to properly modernize Ontario's health care services and to provide the quality care that Ontarians need and deserve; and

 

Be it further resolved that this House strongly condemns both the federal and provincial governments for wasting millions of health care dollars on an advertising war when this money is needed to improve and modernize Ontario's health care services; and

 

Be it further resolved that this House demand that any increase in federal health funding be spent entirely on health care and be applied on top of the levels of health care funding already committed to by the province. Filed on April 3, 2000.

Mr. Hampton - Resolution - That, in the opinion of this House, the provincial and federal governments should reverse the funding cuts that have undermined the operational funding of Ontario's hospitals; and

 

That Hamilton's share of the increased health care dollars be used in such a way that the Henderson will remain a full acute care hospital with a 24-hour-a-day emergency room (along with the other three acute care hospitals) to serve the community of Hamilton Mountain and surrounding areas. Mr. Hastings - Resolution - That in the opinion of this House, the Ontario government should provide effective leadership in the development of an innovative public/private partnership with automotive companies, energy providers, financial institutions and other progressive players in the research and development and later, commercial feasibility of integrating methanol into a fuelcell technology. Mr. Hastings - Resolution - That in the opinion of this House, recognizing the recent onslaught of bugs, viruses and other attacks on the internet and recognizing the government's increasing reliance on electronic and internet technology to provide services and communication to its citizens,

The Ontario government should work with other provincial technology industry leaders and the federal government to establish a protocol to respond to these attacks and prevent them from infiltrating and crippling government services and communications in the future. Filed on June 7, 2000.

Mr. Barrett - Resolution - That this House recognize the following enduring, historic contributions to the founding and development of Upper Canada (Ontario) by our first Lieutenant-Governor, Colonel John Graves Simcoe:

· the settlement of the United Empire Loyalists,

The Adams Mine proposal is much more than a local issue or even a provincial issue because it poses a grave threat to the groundwater and the surface water of Ontario, the Ottawa River, the province of Quebec and to the traditional home and hunting and fishing grounds of the Timiskaming First Nation, and that this House agrees that the proposed Adams Mine landfill must not be built, now or ever, and that the Government should use its power to pass legislation, immediately, to prevent this dangerous landfill site from ever being built;

 

And be it further resolved that this House agrees that there is an alternative to giant landfills, that Edmonton and Halifax have demonstrated that, and that the Government of Ontario should pay heed to the report of its Waste Diversion Organization which says that if Ontario is to meet its goal of diverting 50% of waste away from landfill then it will probably have to ban organics from landfill in Ontario, and that the Government should announce, as soon as possible, the date by which organics will be banned from landfill in the province of Ontario. Mr. Hastings - Resolution - That, in the opinion of this House, we strongly urge the federal government to immediately provide additional funding for Canadian Health Care in the amount of $15 billion. The federal government should be a fully participating partner in medicare and should return to the 1991 funding level of at least 18 cents per capita as opposed to their current spending level of 13 cents per capita; and

The federal government should acknowledge that the federal government under Brian Mulroney subsidized medicare at a level of 18 cents per capita with a $40 billion deficit, while Jean Chretien and the current federal administration has a surplus of $60 billion yet only provides funding at the level of 13 cents per capita. Ms. Churley - Enquiry of the Ministry - Would the Minister of Community and Social Services provide copies of internal reports, published reports, memos, studies, or any written record dealing with:

· The number people on social assistance (Ontario Works and ODSP) who receive rent-geared-to-income in Ontario today and how this compares to 1995;

· The number of people who received ODSP benefits or its equivalent in 1995, 1996, 1997, 1998, 1999, and so far in 2000;

· The number of people who applied for ODSP benefits (or its equivalent) but were denied such benefits in 1995, 1996, 1997, 1998, 1999, so far in 2000; and

· The number of people who apply for ODSP benefits, are denied benefits, appeal to the Social Benefits Tribunal, and receive the right to obtain ODSP benefits. How many are refused ODSP benefits through this channel. How many of those applicants end up on Ontario Works in the interim. June 15, 2000.

Ms. Churley - Enquiry of the Ministry - Would the Minister of Community and Social Services please provide a detailed breakdown of the following:

· In the government's regular reports tallying the number of people who left the welfare rolls, are any efforts made to track where they went to? How many of those who leave Ontario Works end up on ODSP within a one-year period? How many of those who leave Ontario Works end up in full-time, permanent employment within one year of leaving Ontario Works?

· In those regions where call centres have been opened to take in case calls, what is the acceptance rate for Ontario Works and ODSP applicants and what is the refusal rate? How many new cases have been opened at each of these call centres and how does that compare to the number of new cases opened in those regions one year before the call centres originally opened? June 15, 2000.

Mr. Bryant - Enquiry of the Ministry - Would the Attorney General provide specific details of all costs associated with the Province's participation in the Firearms Act reference before the Alberta Court of Appeal, Supreme Court of Canada, and otherwise. June 20, 2000.

Mrs. Dombrosky - Enquiry of the Ministry - Would the Minister of Health and Long term Care provide a list of the following items and services that have been de-listed by the Ministry in the past 24 months:

· Number of medications de-listed from coverage under the Trillium Drug Plan.

· How many Ontario Works participants have been forced to sell cottages as a requirement of their eligibility for Ontario Works benefits? Please provide this information by the year for the past five years.

· What is the actual number of Ontario Works participants who have had liens registered against their homes?

· What percentage of Ontario Works recipients does this represent? September 25, 2000.

Mrs. Dombrosky - Enquiry of the Ministry - Would the Minister of Citizenship, Culture and Recreation responsible for Seniors please provide a written report of the listening tour of retirement homes conducted with taxpayers money by Parliamentary Assistant Brenda Elliott? Specifically, please include who was consulted and indicate what were the key recommendations: a) by the participants, b) by the Parliamentary Assistant? September 25, 2000.

Ms. Lankin - Enquiry of the Ministry - Would the Minister Responsible for Women provide the following information:

 

(a) Provide a list of the women's organizations that received Investing in Women's Futures program funding from the Ontario Women's Directorate for the year 2000.

 

(b) Please list the amount of the annual funding beside each grant recipient.

 

(c) Provide a list of the women's organizations that applied for Investing in Women's Futures program funding for the year 2000 but were denied. Please include the reason for denial. October 26, 2000.

Mr. Christopherson - Enquiry of the Ministry - Would the Minister of Finance provide the following information:

 

(a) Each year, according to quotations made by senior government bureaucrats, the Ontario government accepts $80 million a year from the insurance industry to cover insurer "mistakes". Please provide documentation that clearly articulates the reason for this cash-trade agreement, including an outline of the kinds of "mistakes" the payment is presumed to cover.

 

(b) Please outline which statutory obligations this agreement covers.

 

(c) Please include any documentation that explains why $80 million was the agreed-upon figure in this arrangement.

 

(d) Please include documentation that shows where that $80 million goes into the Ministry of Finance (or other ministry) budgets. October 26, 2000.
