An Act to amend the Crop Insurance Act (Ontario), 1996 and to make consequential amendments to other Acts
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. The title of the Crop Insurance Act (Ontario), 1996 is repealed and the following substituted:
Agricultural Products Insurance Act, 1996
2. (1) Section 1 of the Act is amended by adding the following definition:
"agricultural products" means a product that is designated by regulation; ("produits agricoles")
(2) The definition of "contract of insurance" in section 1 of the Act is amended by striking out "agricultural crops or perennial plants" and substituting "agricultural products".
(3) Section 1 of the Act is amended by adding the following definition:
"Fund" means the Ontario Agricultural Products Insurance Fund; ("Caisse")
3. (1) Subsection 2.1 (1) of the Act is amended by striking out "agricultural crops and perennial plants" and substituting "agricultural products".
(2) Subsection 2.1 (2) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(3) Subsection 2.1 (3) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(4) Subsection 2.1 (4) of the Act is amended by striking out "agricultural crop or perennial plant" in the portion before clause (a) and substituting "agricultural product".
(5) Clause 2.1 (4) (a) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(6) Clause 2.1 (4) (b) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(7) Clause 2.1 (4) (c) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
4. (1) Clause 5 (2) (a) of the Act is amended by striking out "agricultural crop or perennial plant" at the end and substituting "agricultural product".
(2) Subsection 5 (4) of the Act is amended by striking out "agricultural crop or perennial plant" in the portion before clause (a) and substituting "agricultural product".
(3) Clause 5 (4) (a) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(4) Subsection 5 (5) of the Act is amended by striking out "agricultural crop or perennial plant" wherever it appears and substituting in each case "agricultural product".
(5) Subsection 5 (6) of the Act is amended by striking out "agricultural crop or perennial plant" wherever it appears and substituting in each case "agricultural product".
(6) Subsection 5 (7) of the Act is amended by striking out "agricultural crop or perennial plant" in the portion before paragraph 1 and substituting "agricultural product".
(7) Paragraph 1 of subsection 5 (7) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(8) Paragraph 2 of subsection 5 (7) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(9) Paragraph 3 of subsection 5 (7) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(10) Subsection 5 (8) of the Act is amended by striking out "agricultural crop or perennial plant" in the portion before paragraph 1 and substituting "agricultural product".
(11) Paragraph 1 of subsection 5 (8) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
(12) Paragraph 2 of subsection 5 (8) of the Act is amended by striking out "agricultural crop or perennial plant" wherever it occurs and substituting in each case "agricultural product".
(13) Paragraph 3 of subsection 5 (8) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
5. Subclause 8 (1) (b) (i) of the Act is amended by striking out "the crops or perennial plants" at the beginning and substituting "the agricultural products".
6. The definition of "final report" in subsection 10 (5) of the Act is amended by striking out "agricultural crop or perennial plant" and substituting "agricultural product".
7. Subsection 11 (1) of the Act is repealed and the following substituted:
Fund
(1) The fund known in English as the Ontario Crop Insurance Fund and in French as Caisse d'assurance-récolte de l'Ontario is continued as the Ontario Agricultural Products Insurance Fund in English and as the Caisse d'assurance des produits agricoles de l'Ontario in French.
8. The Act is amended by adding the following section:

11.1 The Minister may make regulations,
(a) designating agricultural products for the purposes of this Act;
(b) defining any word or expression used in this Act that has not already been expressly defined in this Act.
Consequential Amendments
AgriCorp Act, 1996
9. Clause 2 (a) of the AgriCorp Act, 1996 is amended by striking out "Crop Insurance Act (Ontario), 1996" and substituting "Agricultural Products Insurance Act, 1996".
Ministry of Agriculture, Food and Rural Affairs Act
10. Subsection 14 (6.1) of the Ministry of Agriculture, Food and Rural Affairs Act is amended by striking out "Crop Insurance Act (Ontario), 1996" and substituting "Agricultural Products Insurance Act, 1996".
Retail Sales Tax Act
11. Subsection 2.1 (10) of the Retail Sales Tax Act is amended by striking out "Crop Insurance Act (Ontario), 1996" and substituting "Agricultural Products Insurance Act, 1996".
Commencement and Short title
Commencement
12. This Act comes into force on a day to be named by proclamation of the Lieutenant Governor.
Short title
13. The short title of this Act is the Agriculture Insurance Act (Amending the Crop Insurance Act, 1996), 2015.
EXPLANATORY NOTE
This Explanatory Note was written as a reader's aid to Bill 40 and does not form part of the law. Bill 40 has been enacted as Chapter 6 of the Statutes of Ontario, 2015.
The Bill amends the Crop Insurance Act (Ontario), 1996 to expand the scope of the Act. Currently the Act applies to agricultural crops and perennial plants. The Bill would expand the Act so that it would apply to all agricultural products that are designated by the Minister by regulation.
The title of the Act is amended to reflect the expanded scope of the legislation.
