An Act to amend the Ontario College of Trades and Apprenticeship Act, 2009

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Section 7 of the Ontario College of Trades and Apprenticeship Act, 2009 is repealed.

   2.  (1)  Paragraph 3 of subsection 36 (1) of the Act is repealed.

   (2)  Subsection 36 (2) of the Act is amended by adding "and" at the end of clause (a), striking out "and" at the end of clause (b) and by repealing clause (c).

   3.  Subsection 37 (10) of the Act is amended by striking out "subparagraphs 3 i to iv" and substituting "subparagraphs 3 i to iii".

   4.  Subsection 53 (6) of the Act is repealed.

   5.  Subsection 54 (1) of the Act is amended by striking out "subparagraphs 3 i to iv" and substituting "subparagraphs 3 i to iii".

   6.  Section 56 of the Act is amended by striking out "subparagraphs 3 i to iv" and substituting "subparagraphs 3 i to iii".

   7.  Subsection 70 (8) of the Act is amended by striking out "subparagraphs 3 i to iv" and substituting "subparagraphs 3 i to iii".

   8.  Subparagraph 3 iv of subsection 72 (1) of the Act is repealed.

   9.  Subsection 86 (1) of the Act is amended by striking out "subparagraphs 3 i to iv" and substituting "subparagraphs 3 i to iii".

Commencement

   10.  This Act comes into force six months after the day it receives Royal Assent.

Short title

   11.  The short title of this Act is the No New Tax for Businesses Act, 2013.

 

EXPLANATORY NOTE

Currently, the Ontario College of Trades and Apprenticeship Act, 2009 includes a section that is not in force that would prohibit a person from employing journeypersons or sponsoring or employing apprentices unless the person is a member of the College. The Bill repeals that section and related provisions. The Bill also eliminates the class of membership for persons who employ journeypersons or who sponsor or employ apprentices.
