An Act to amend the Highway Traffic Act with respect to brake pad standards and specifications

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  (1)  Section 64 of the Highway Traffic Act is amended by adding the following subsection:

Brake pads

   (1.1)  If a motor vehicle described in subsection (1) is equipped with brake pads,

  (a)  the brake pads shall meet the prescribed standards and specifications; and

  (b)  the brake pads shall not contain asbestos.

   (2)  Subsection 64 (6) of the Act is amended by adding the following clause:

(b.1) prescribing standards and specifications for brake pads for the purposes of clause (1.1) (a), including but not limited to prescribing edge code marking requirements;

Commencement

   2.  This Act comes into force six months after the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Highway Traffic Amendment Act (Brake Pad Standards), 2012.

 

EXPLANATORY NOTE

The Bill amends the Highway Traffic Act to require that motor vehicles, other than motorcycles, that are equipped with brake pads be equipped with brake pads that meet the prescribed standards and specifications and that do not contain asbestos.
