An Act to repeal the Far North Act, 2010 and to make consequential amendments to other Acts

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Far North Act, 2010

   1.  (1)  The Far North Act, 2010 is repealed.

   (2)  Ontario Regulations 21/11 (Description of the Far North) and 117/11 (Prohibited Developments: Opening a Mine) made under the Act are revoked.

Mining Act

   2.  (1)  The definitions of "community based land use plan" and "Far North" in subsection 1 (1) of the Mining Act are repealed.

   (2)  Section 30 of the Act is amended by adding "or" at the end of clause (e), by striking out "or" at the end of clause (f) and by repealing clause (g).

   (3)  Clause 35 (2) (a) of the Act is repealed and the following substituted:

  (a)  whether the lands, mining rights or surface rights are required for developing or operating public highways, renewable energy projects or power transmission lines or for another use that would benefit the public and whether the lands meet the prescribed criteria as a site of Aboriginal cultural significance; and

   (4)  Part XIV of the Act, being sections 204 and 205, is repealed.

Provincial Parks and Conservation Reserves Act, 2006

   3.  Subsections 9 (6), (7) and (8) of the Provincial Parks and Conservation Reserves Act, 2006 are repealed.

Public Lands Act

   4.  (1)  The definition of "land use plan" in section 1 of the Public Lands Act is repealed.

   (2)  Sections 12, 12.1, 12.2 and 12.3 of the Act are repealed.

Commencement and Short Title

Commencement

   5.  (1)  Subject to subsections (2) to (5), this Act comes into force on the day it receives Royal Assent.

   (2)  Subsection 2 (1) comes into force on the later of the day subsection 1 (2) of the Mining Amendment Act, 2009 comes into force and the day this Act receives Royal Assent.

   (3)  Subsection 2 (2) comes into force on the later of the day section 12 of the Mining Amendment Act, 2009 comes into force and the day this Act receives Royal Assent.

   (4)  Subsection 2 (3) comes into force on the later of the day subsection 14 (1) of the Mining Amendment Act, 2009 comes into force and the day this Act receives Royal Assent.

   (5)  Subsection 2 (4) comes into force on the later of the day section 100 of the Mining Amendment Act, 2009 comes into force and the day this Act receives Royal Assent.

Short title

   6.  The short title of this Act is the Far North Repeal Act, 2012.

 

EXPLANATORY NOTE

The Bill repeals the Far North Act, 2010 and all provisions of other Acts that refer to the Act.
