An Act to preserve the gravesites of former premiers of Ontario

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Definitions

1.  In this Act,

"gravesites" means the gravesites listed in Schedule 1 to this Act; ("lieux de sépulture")

"Minister" means the Minister of Culture or such other member of the Executive Council to whom administration of this Act is assigned under the Executive Council Act. ("ministre")

Purpose

2.  The purpose of this Act is to preserve the gravesites of former premiers of Ontario.

Power of Minister

3.  (1)  The Minister shall, by means of flags of Ontario and of Canada, plaques, signs and other suitable markings, mark the gravesites of former premiers of Ontario.

(2)  In exercising his or her powers under subsection (1), the Minister shall,

(a) ensure that the plaques, signs and other markings conform with the by-laws that are approved or prescribed under the Cemeteries Act (Revised) of the cemetery where the gravesite is located; and

(b) consult with the family of the deceased premier and respect the wishes of the family in determining how to appropriately mark the gravesite.

(3)  The Minister may,

(a) make agreements with any person for marking or commemorating the gravesites and for the care and preservation of such gravesites; and

(b) by order, add additional gravesites to Schedule 1 to this Act.

Commencement

4.  This Act comes into force on the day it receives Royal Assent.

Short title

5.  The short title of this Act is the Gravesites of Former Premiers Act, 2005.

EXPLANATORY NOTE

The Bill requires the Minister of Culture to mark gravesites of former premiers of Ontario and permits the Minister to make agreements for the care and preservation of such gravesites. In marking the gravesites, the Minister shall comply with the by-laws of the cemetery where the gravesite is located and shall respect the wishes of the family of the deceased premier.
