An Act to amend the
Niagara Escarpment Planning
and Development Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  The Niagara Escarpment Planning and Development Act is amended by adding the following section:

Restriction

6.2  (1)  Despite section 6.1, no amendment to the Plan may be initiated by the Minister or by the Commission and no application may be made to the Commission by any person, ministry or municipality requesting an amendment to the Plan under that section if the effect of the amendment would be to establish or expand an urban area, minor urban centre or escarpment recreation area designation.

Limited application

(2)  Despite subsection (1), the Minister may consider the establishment or expansion of urban areas, minor urban centres or escarpment recreation areas as part of the regular review of the Plan under section 17.

Commencement

2.  This Act comes into force on the day it receives Royal Assent.

Short title

3.  The short title of this Act is the Niagara Escarpment Planning and Development Amendment Act, 2004.

EXPLANATORY NOTE

No amendment to the Plan made under the Niagara Escarpment Planning and Development Act may be made if the effect of the amendment would be to establish or expand an urban area, minor urban centre or escarpment recreation area designation, except in accordance with the terms of reference of the 10-year review under the Act.
