Government Notice of Motion Number 51

Avis de motion numéro 51 émanant du gouvernement

Mr. Sterling - Resolution - That pursuant to Standing Order 46 and notwithstanding any other Standing Order or Special Order of the House relating to Bill 74, An Act to amend the Education Act to increase education quality, to improve the accountability of school boards to students, parents and taxpayers and to enhance students' school experience, when Bill 74 is next called as a government Order, the Speaker shall put every question necessary to dispose of the second reading stage of the bill without further debate or amendment, and at such time, the bill shall be ordered to the Standing Committee on Justice and Social Policy; and

That no deferral of the second reading vote pursuant to Standing Order 28(h) shall be permitted; and

That the Standing Committee on Justice and Social Policy shall be authorized to meet the morning of Wednesday, June 7, 2000, in Barrie, for public hearings and on Friday, June 9, 2000 in Ottawa for public hearings and on Monday, June 12, 2000 in Toronto at its regularly scheduled time for clause-by-clause consideration of the bill, and that the Committee be authorized to meet beyond its normal hour of adjournment on that day until completion of clause-by-clause consideration; and

That, at 4:30 p.m. on the final day designated by the Committee for clause-by-clause consideration of the bill, and not later than June 12, 2000, those amendments which have not been moved shall be deemed to have been moved, and the Chair of the Committee shall interrupt the proceedings and shall, without further debate or amendment, put every question necessary to dispose of all remaining sections of the bill, and any amendments thereto. Any division required shall be deferred until all remaining questions have been put and taken in succession with one 20-minute waiting period allowed pursuant to Standing Order 127(a); and

That the Committee shall report the bill to the House not later than the first Sessional day that reports from Committees may be received following the completion of clause-by-clause consideration, and not later than June 13, 2000. In the event that the committee fails to report the bill on the date provided, the bill shall be deemed to have been passed by the Committee and shall be deemed to be reported to and received by the House; and

That upon receiving the report of the Standing Committee on Justice and Social Policy, the Speaker shall put the question for adoption of the report forthwith, and at such time the bill shall be ordered for third reading; and

That, when the Order for Third Reading is called, two hours and thirty minutes shall be allotted to the Third Reading stage of the bill. At the end of such time, the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of the bill without further debate or amendment; and

That, the vote on third reading may, pursuant to Standing Order 28(h), be deferred until the next Sessional day during the Routine Proceeding "Deferred Votes"; and

That, in the case of any division relating to any proceedings on the bill, the division bell shall be limited to five minutes.

Mr. Sterling - Resolution - That, in the opinion of this House, in response to the nearly $30 billion Employment Insurance surplus and to prevent the payroll tax increase currently scheduled for January 1, 2000, the Federal Government must create jobs by reducing job-killing payroll taxes, including the introduction of a significant cut to EI premiums to at least $2 per $100 of insurable earnings. Mr. Sterling - Resolution - That pursuant to Standing Order 46 and notwithstanding any other Standing Order or Special Order of the House relating to Bill 74, An Act to amend the Education Act to increase education quality, to improve the accountability of school boards to students, parents and taxpayers and to enhance students' school experience, when Bill 74 is next called as a government Order, the Speaker shall put every question necessary to dispose of the second reading stage of the bill without further debate or amendment, and at such time, the bill shall be ordered to the Standing Committee on Justice and Social Policy; and

That no deferral of the second reading vote pursuant to Standing Order 28(h) shall be permitted; and

Any division required shall be deferred until all remaining questions have been put and taken in succession with one 20-minute waiting period allowed pursuant to Standing Order 127(a); and

That the Committee shall report the bill to the House not later than the first Sessional day that reports from Committees may be received following the completion of clause-by-clause consideration, and not later than June 13, 2000. In the event that the committee fails to report the bill on the date provided, the bill shall be deemed to have been passed by the Committee and shall be deemed to be reported to and received by the House; and

That upon receiving the report of the Standing Committee on Justice and Social Policy, the Speaker shall put the question for adoption of the report forthwith, and at such time the bill shall be ordered for third reading; and

That, when the Order for Third Reading is called, two hours and thirty minutes shall be allotted to the Third Reading stage of the bill. The Lieutenant Governor in Council, under the Public Inquiries Act, should by commission appoint one or more persons to inquire into a matter of grave public concern, Ontario's water supply and the safety of the Province's drinking water;

That the commission should inquire into:

(1) The adequacy of the legislation and regulations governing the provision of, standards for and testing of the Province's drinking water;

(2) The adequacy of the inspection and monitoring programs for all provincial water systems, and the role of the Province in guaranteeing adequate testing and public notification, including funding and staffing considerations;

(3) The extent to which the matters under (1) and (2) may have been factors in the Walkerton water tragedy; and

(4) Such other matters as the commission considers appropriate to ensure that the tragedy of Walkerton does not ever happen again anywhere in this Province;

That the commission shall report its findings and make recommendations it considers advisable;

That the commission shall not express any conclusions regarding the criminal or civil liability of any person or organization;

That the commission shall complete this inquiry and deliver its final report containing its findings, conclusions and recommendations six months from the day of its establishment and appointment of its members;

That the three House Leaders are consulted and must approve the appointee(s) to the inquiry, any changes or additions to the above terms of reference for the commission and the reporting date for the commission's interim and final reports within one week of the Legislature's approval of this motion. Since the provincial government failed the people of Walkerton in its duty to protect our drinking water - which killed people and made them sick; and

Since the provincial government's motion to call for a legislative committee is an insufficient attempt to uncover the causes of this failure; and

Since the provincial government has refused to conduct a full independent public inquiry into the safety of drinking water across Ontario to ensure that the Walkerton tragedy does not happen anywhere else in Ontario ever again;

Therefore, the government no longer has the confidence of this House. Filed on May 30, 2000.

Mr. Hampton - Resolution - That this House express its concern for the increasing number of Ontario children living in poverty and seek to achieve the goal of eliminating poverty among Ontario children by adopting the recommendations of Ontario Campaign 2000. Filed on December 1, 1999.

Mr. Hampton - Resolution - Be it resolved that,

1) this Assembly deplores the continuing violations of human rights in Burma, including extrajudicial and arbitrary executions, rape, torture, inhumane treatment, mass arrests, forced labour, forced relocation, and denial of freedom of expression, assembly, association, and movement, as reported by the UN Human Rights Special Rapporteur.

2) these human rights abuses in Burma are the result of policy at the highest level and the
regime's officials bear political and legal responsibility for them.

 

3) this Assembly urges the military regime in Burma to:

a) immediately and unconditionally release all detained political leaders and political prisoners, to ensure their physical integrity and to permit them to participate in the process of national reconciliation;

b) repeal all regressive laws;

c) stop all the violations of human rights and in particular the unlawful coercion against the National League for Democracy (NLD) members leading to surrendering of their membership and the closure of NLD offices; and

d) immediately initiate a substantive political dialogue with the Committee Representing the People's Parliament before there is further violent upheaval in Burma.

 

4) this Assembly condemns the State Peace and Development Council (formerly named the State Law and Order Restoration Council) for:

a) openly encouraging the production, trade and export of opium and heroin into North America; and

b) racially-motivated genocide against the ethnic peoples in Burma, especially those in Karen, Karenni and Shan States; and

 

5) this Assembly urges the Government of Canada to:

a) recognize as the legitimate instrument of the will of the Burmese people the Committee Representing the People's Parliament formed by the National League for Democracy on 15 September 1998 as acquiring the legal authority of 251 MPs and support of the four non-Burman ethnic political parties;

b) take all necessary action to achieve coordinated international action in support of the restoration of human rights in Burma;

c) appeal to the UN Secretary-General to send a special envoy to Burma to continue discussions with the leaders of the military regime as well as with Daw Aung San Suu Kyi and other leaders in order to make significant advances towards the democratization of Burma. Filed on December 15, 1999.

Ms. Churley - Resolution - That, in the opinion of this House, the General Government Committee reconvene to re-open consideration of the appointment of the Environmental Commissioner, and that, in arriving at its decision, the committee consider the policies of the Office, including Section 7.2 and 7.3 of the Policies and Procedures Manual of the Environmental Commissioner of Ontario which read as follows:

"The high conflict of interest threshold is more stringent for the Offices of the Provincial Legislature, such as the Environmental Commissioner, which performs an independent review of the provincial government."

 

"ECO employees must not participate in activities that might identify them as members or supporters of a political party."

Mr. McGuinty - Resolution - That, in the opinion of this House, the current levels of health care funding provided by both the federal and provincial governments are insufficient to properly modernize Ontario's health care services and to provide the quality care that Ontarians need and deserve; and

 

Be it further resolved that this House strongly condemns both the federal and provincial governments for wasting millions of health care dollars on an advertising war when this money is needed to improve and modernize Ontario's health care services; and

 

Be it further resolved that this House demand that any increase in federal health funding be spent entirely on health care and be applied on top of the levels of health care funding already committed to by the province. Filed on April 3, 2000.

Mr. Hampton - Resolution - That, in the opinion of this House, the provincial and federal governments should reverse the funding cuts that have undermined the operational funding of Ontario's hospitals; and

 

That Hamilton's share of the increased health care dollars be used in such a way that the Henderson will remain a full acute care hospital with a 24-hour-a-day emergency room (along with the other three acute care hospitals) to serve the community of Hamilton Mountain and surrounding areas.
