EXPLANATORY NOTE

The Bill amends the Building Code Act, 1992 to provide that the building code shall not prohibit a building that is 12 storeys or less in building height from being of wood frame construction. This does not prevent the code from imposing requirements on or prohibiting specified classes of wood frame buildings.

An Act to amend the Building Code Act, 1992 with respect to the height of wood frame buildings

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1 The Building Code Act, 1992 is amended by adding the following section:

Building code restriction, wood frame buildings

34.0.1 (1)  The building code shall not prohibit a building that is 12 storeys or less in building height from being of wood frame construction.

(2)  For greater certainty, subsection (1) does not prevent the building code from,

  (a)  imposing requirements on buildings of wood frame construction; and

  (b)  prohibiting specified classes of buildings from being of wood frame construction.

Commencement

2 This Act comes into force four months after the day it receives Royal Assent.

Short title

3 The short title of this Act is the Ontario Forestry Industry Revitalization Act (Height of Wood Frame Buildings), 2017.
