EXPLANATORY NOTE

The Bill requires the Minister to adjust the funding provided to long-term care homes with which the Minister has an agreement or arrangement to provide funding to the home with respect to its ongoing operating costs as of January 1 in a given year. The amount of any increase in funding required as a result of the adjustment is to be paid out of funds appropriated for that purpose by the Legislature.

An Act to amend the Long-Term Care Homes Act, 2007

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1 Section 90 of the Long-Term Care Homes Act, 2007 is amended by adding the following subsections:

Annual adjustment

(1.1)  If, as of January 1 in a given year, the Minister has an agreement or arrangement in place to provide funding to a long-term care home with respect to its ongoing operating costs, including with respect to the cost of food and utilities, the Minister shall, on or before January 31, adjust the amount of funding set out in the agreement or arrangement, or, if the funding has been adjusted in a previous year under this subsection, that amount, in accordance with subsection (1.2).

Percentage of adjustment

(1.2)  The Minister shall adjust the funding by the percentage change between,

  (a)  the Ontario Consumer Price Index for the 12-month period immediately preceding the 12-month period described in clause (b); and

  (b)  the Ontario Consumer Price Index for the 12-month period ending on December 31 of the previous calendar year.

Consumer Price Index

(1.3)  For the purposes of subsection (1.2), the Ontario Consumer Price Index for a 12-month period is the Consumer Price Index for Ontario (All-Items) as reported monthly by Statistics Canada under the authority of the Statistics Act (Canada), averaged over the 12-month period.

No negative adjustment

(1.4)  Despite subsection (1.1), if the percentage change in the Ontario Consumer Price Index between the 12-month period referred to in clause (1.2) (a) and the 12-month period referred to in clause (1.2) (b) is a negative amount, the Minister shall not adjust the funding.

Cost of adjustment

(1.5)  The amount of any increase in funding required as a result of the adjustment under subsection (1.1) shall be paid out of funds appropriated for that purpose by the Legislature.

Commencement

2 This Act comes into force on the day it receives Royal Assent.

Short title

3 The short title of this Act is the Long-Term Care Homes Amendment Act, 2017.
