An Act to amend the Juries Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Section 6 of the Juries Act is amended by adding the following subsections:

Exception, 65 or older

   (2.1)  Despite subsection (2), the Director of Assessment shall not select as a person to whom a jury service notice is to be mailed in a year any person who,

  (a)  has attained the age of 65 years or older or will attain the age of 65 by the end of the year; and

  (b)  has sent to the Director, by September 1 of the year or in any previous year, a letter indicating that he or she does not wish to receive a jury service notice.

Requirements re letter

   (2.2)  The letter mentioned in subsection (2.1) shall include the information prescribed by and be sent in accordance with the regulations.

   2.  Section 8 of the Act is amended by adding the following subsection:

Same, 65 or older

   (3.1)  The sheriff shall omit from the jury roll the name of any person who,

  (a)  has attained the age of 65 years or older or will attain the age of 65 by the end of the year; and

  (b)  has indicated on the return to jury service notice that he or she does not wish to be entered in the jury roll.

   3.  Section 37 of the Act is amended by adding the following clause:

(a.1) prescribing the information that shall be included in a letter mentioned in subsection 6 (2.1) and governing the manner and form in which it shall be sent;

Commencement

   4.  This Act comes into force on the day it receives Royal Assent.

Short title

   5.  The short title of this Act is the Juries Amendment Act, 2014.

 

EXPLANATORY NOTE

The Bill amends the Juries Act to permit persons 65 years or older to elect not to receive a jury service notice, and not to be entered into the jury roll.
