An Act to amend the Residential Tenancies Act, 2006 with respect to the exemption from rules relating to rent increases

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  (1)  Subsection 6 (2) of the Residential Tenancies Act, 2006 is amended by adding "or" at the end of clause (a), by striking out "or" at the end of clause (b) and by repealing clause (c).

   (2)  Section 6 of the Act is amended by adding the following subsection:

   (3)  Sections 104, 111, 112, 120, 121, 122, 126 to 133, 165 and 167 do not apply with respect to a rental unit before the day the Residential Tenancies Amendment Act (Rent Increases), 2011 comes into force if no part of the building, mobile home park or land lease community was occupied for residential purposes before November 1, 1991.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Residential Tenancies Amendment Act (Rent Increases), 2011.

 

EXPLANATORY NOTE

The Bill amends the Residential Tenancies Act, 2006. At present, the rules relating to rent increases do not apply to a rental unit if the building, mobile home park or land lease community in which the unit is located was not occupied for residential purposes before November 1, 1991. The Bill removes that exemption, but not retroactively.
