An Act to amend the Ontario Energy Board Act, 1998

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Section 26.1 of the Ontario Energy Board Act, 1998 is repealed.

   2.  Subsections 26.2 (1) and (2) of the Act are amended by adding "as it read before its repeal" after "section 26.1" wherever that expression appears.

Commencement

   3.  This Act comes into force on the day it receives Royal Assent.

Short title

   4.  The short title of this Act is the Repeal of the Hidden Energy Taxes Act, 2010.

EXPLANATORY NOTE

The Bill repeals section 26.1 of the Ontario Energy Board Act, 1998 which allows the Board to collect money from consumers in their service areas, gas distributors, licensed distributors, the Independent Electricity Service Operator and any other person prescribed by the regulations made under the Act. The Act requires that all money collected be paid to Ontario for certain purposes as set out in the Act. The Bill does not affect the use of money payable under section 26.1 of the Act before its repeal.
