An Act to amend the Lobbyists Registration Act, 1998 to prohibit consultant lobbyists from lobbying on behalf of public entities

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  The short title of the Lobbyists Registration Act, 1998 is repealed and the following substituted:

Lobbyists Registration and Restrictions Act, 1998

   2.  Subsection 1 (1) of the Act is amended by adding the following definition:

"public entity" means,

  (a)  a Crown agency,

  (b)  a corporation, with or without share capital, that is not a Crown agency but is owned, operated or controlled by the Crown,

   (c)  a children's aid society that is designated in accordance with the Child and Family Services Act,

  (d)  a district school board as defined in subsection 1 (1) of the Education Act,

  (e)  a person or entity that is a health service provider for the purposes of the Local Health System Integration Act, 2006,

    (f)  a municipality as defined in section 1 of the Municipal Act, 2001,

  (g)  a college of applied arts and technology established under the Ontario Colleges of Applied Arts and Technology Act, 2002,

   (h)  a university in Ontario, including its affiliated and federated colleges, that receives operating grants from the Government of Ontario,

    (i)  any other board, commission, authority or unincorporated body of the Crown;  ("entité publique")

   3.  The Act is amended by adding the following section:

Lobbying on Behalf of Public Entities

Prohibition, public entity

   17.1  No consultant lobbyist referred to in section 4 shall undertake to lobby on behalf of a public entity.

   4.  Section 18 of the Act is amended by adding the following subsection:

Offence re public entity

   (4.1)  Every consultant lobbyist who contravenes section 17.1 is guilty of an offence.

Commencement

   5.  This Act comes into force on the day it receives Royal Assent.

Short title

   6.  The short title of this Act is the Lobbyists Registration Amendment Act (Public Entities), 2010.

 

EXPLANATORY NOTE

The Bill amends the Lobbyists Registration Act, 1998 to prohibit consultant lobbyists from lobbying on behalf of public entities.  The Bill also changes the title of the Act to the Lobbyists Registration and Restrictions Act, 1998.
