An Act to amend the Ministry of Government Services Act to regulate the acquisition of government vehicles

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  The Ministry of Government Services Act is amended by adding the following section:

Acquisition of vehicles by Government

   16.1  (1)  A vehicle acquired by or on behalf of the Government, whether by purchase, lease, rental or otherwise, shall meet the following criteria:

    1.  At least 62 per cent of the time spent on the combined total of the manufacturing and assembly of the vehicle shall be spent,

            i.  in Canada, if it is cost effective and feasible from an operational perspective, or

           ii.  in North America, if it is cost effective and feasible from an operational perspective.

    2.  Consideration shall be given to the acquisition, whether by purchase, lease, rental or otherwise, of the following, if it is cost effective and feasible from an operational perspective:

            i.  A hybrid vehicle, as defined in the regulations.

           ii.  An alternative fuel vehicle, as defined in the regulations.

          iii.  Another type of advanced technology vehicle.

    3.  The vehicle shall include equipment that aims to optimize the life-cycle cost, purchase price and resale value of the vehicle, if this equipment is available from the manufacturer and it is cost effective.

    4.  If the vehicle is a passenger car, station wagon or van, it shall be compact size, sub-compact size or mid-size, as defined in the regulations, unless the acquisition of a larger vehicle has been approved in accordance with the regulations.

    5.  If the vehicle is a passenger car, station wagon or van, it shall have an engine capacity that will allow effective and efficient program delivery.

Definitions

   (2)  In this section,

"regulations" means the regulations made under subsection (3); ("règlements")

"vehicle" means any of the following, as defined in the regulations:

    1.  A passenger car, station wagon or van.

    2.  A commercial van, pick-up truck or heavy truck.

    3.  A truck tractor equipped with a fifth wheel, trailer, float or construction trailer.

    4.  A snowmobile, an all terrain vehicle, a motorcycle or a boat equipped with a trailer. ("véhicule")

Regulations

   (3)  The Lieutenant Governor in Council may make regulations,

  (a)  defining any word or term that is referred to in this section as being defined in the regulations;

  (b)  prescribing the requirements for the approval referred to under paragraph 4 of subsection (1).

Commencement

   2.  This Act comes into force six months after the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Ministry of Government Services Amendment Act (Canadian Manufacturing and Assembly of Government Vehicles), 2008.

 

EXPLANATORY NOTE

Currently, there are no legislative requirements relating to vehicles purchased, leased or rented for government use.  The Bill amends the Ministry of Government Services Act to establish such requirements.  They include that at least 62 per cent of the time spent on the combined total of the manufacturing and assembly of vehicles be spent in Canada if it is cost effective and feasible from an operational perspective, or in North America if it is cost effective and feasible from an operational perspective.
