An Act to amend the Day Nurseries Act with respect to sun protection for children

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  The Day Nurseries Act is amended by adding the following section:

Sun protection

   17.1  (1)  Every operator of a day nursery shall ensure that adequate sun protection is provided to a child in its care before the child is expected to be outdoors for more than half an hour, unless a physician or parent of the child advises otherwise in writing.

   (2)  Methods of providing adequate sun protection include,

  (a)  applying sunscreen to the child;

  (b)  ensuring that the child is in a shaded area;

   (c)  ensuring that the child is outdoors only during shady weather or shady times of the day; and

  (d)  ensuring that the child is wearing appropriate clothing to cover his or her head, arms, legs and body.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Day Nurseries Amendment Act (Sun Protection), 2009.

 

EXPLANATORY NOTE

The Bill amends the Day Nurseries Act to require every operator of a day nursery to provide adequate sun protection to a child in its care if the child will be outdoors for more than half an hour, unless a physician or parent of the child advises otherwise.
