An Act respecting Master's College and Seminary

Preamble

The board of governors of Master's College and Seminary has applied for special legislation to exempt certain land from taxation for municipal and school purposes, other than local improvement rates, while the land is used for a specified purpose and to cancel the taxes for municipal and school purposes, other than local improvement rates, on the land for part of 2003 and for 2004 and 2005. The applicant represents that Master's College and Seminary was incorporated by special legislation in 1983 under the name Eastern Pentecostal Bible College and that it was continued by special legislation in 2001 under the name Master's College and Seminary. The applicant further represents that Master's College and Seminary is a registered charity within the meaning of the Income Tax Act (Canada) and that Master's College and Seminary occupies certain land leased by it.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  The Master's College and Seminary Act, 2001 is amended by adding the following section:

Tax exemption

9.1  (1)  Beginning January 1, 2006, the specified property is exempt from taxation for municipal and school purposes, other than local improvement rates, if,

(a) the specified property is occupied and used solely for the purposes of Master's College and Seminary; and

(b) Master's College and Seminary is a registered charity within the meaning of the Income Tax Act (Canada).

Taxes cancelled

(2)  The taxes for municipal and school purposes, other than local improvement rates, on the specified property are cancelled for the period from August 1 to December 31, 2003 and for the years 2004 and 2005.

Chargeback

(3)  Sections 337.1 (adjustments) and 353 (taxes collected on behalf of other bodies) of the Municipal Act, 2001 apply, with necessary modifications, to taxes cancelled under subsection (2).

Definition

(4)  In this section,

"specified property" means the lands and premises used and occupied by Master's College and Seminary at 3080 Yonge Street in the City of Toronto, being part of the lands currently assessed as 1904116 010059000000 and further described in Schedule 1.

2.  The Act is amended by adding the following Schedule:

Sixthly:

Those lands in the City of Toronto (formerly in The Municipality of Metropolitan Toronto) and Province of Ontario being composed of part of Lot 1 according to a plan registered in the Registry Office for the Registry Division of the County of York as Number 1303 and now filed in the Registry Office for the Registry Division of the said City of Toronto and part of Lot 6, Concession 1, West of Yonge Street and designated as Parts 1 to 12 inclusive on a plan deposited in the said City Registry Office as Number 63R-823.

RESERVING thereout and therefrom to The Municipality of Metropolitan Toronto, its successors and assigns, easements or rights in the nature of easements to pass through all the subsoil and subsurface of the following lands for the purpose of constructing, maintaining, repairing, reconstructing and operating the Rapid Transit System of The Toronto Transit Commission, including a station and a bus structure for the Lawrence Avenue Station:

a. Part 3 on Plan 63R-823 lying below a plane having an elevation of 545.54 feet Geodetic Datum;

b. Part 4 on Plan 63R-823 lying below a plane having an elevation of 525.00 feet Geodetic Datum;

c. Part 7 on Plan 63R-823 lying below a plane having an elevation of 530.70 feet Geodetic Datum;

d. Part 8 on Plan 63R-823 lying below a plane having an elevation of 531.00 feet Geodetic Datum;

e. Part 9 on Plan 63R-823 lying below a plane having an elevation of 534.00 feet Geodetic Datum;

f. Part 10 on Plan 63R-823 lying below a plane having an elevation of 524.62 feet Geodetic Datum;

g. Part 11 on Plan 63R-823 lying below a plane having an elevation of 525.14 feet Geodetic Datum.

AND FURTHER RESERVING thereout and therefrom to The Municipality of Metropolitan Toronto, its successors and assigns, an easement or rights in the nature of an easement to maintain, repair, reconstruct and operate a vent shaft in connection with the Rapid Transit System of The Toronto Transit Commission on the lands being Part 5 on Plan 63R-823.

AND FURTHER RESERVING thereout and therefrom to The Municipality of Metropolitan Toronto, its successors and assigns, an easement or rights in the nature of an easement to maintain, repair, reconstruct and operate a vent shaft and bus access structure on that part of Part 6 on Plan 63R-823 lying below a plane having an elevation of 537.00 feet Geodetic Datum.

Commencement

3.  This Act comes into force on the day it receives Royal Assent.

Short title

4.  The short title of this Act is the Master's College and Seminary Act, 2006.
