An Act to amend the Liquor Licence Act and the Liquor Control Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Liquor Licence Act

   1.  Section 12 of the Liquor Licence Act is amended by adding the following subsection:

   (2.1)  It is a condition of a licence to sell liquor that the licensee affix to the container, in which the manufacturer places the liquor, a warning label that cautions women who are pregnant that the consumption of alcohol during pregnancy is the cause of Fetal Alcohol Spectrum Disorder.

   2.  Section 14 of the Act is amended by adding the following subsection:

   (2.1)  Despite subsection 14 (2), a member of the Board shall not remove a condition attached to a licence pursuant to subsections 12 (2.1) and 22 (3.1). 

   3.  Section 22 of the Act is amended by adding the following subsection:

   (3.1)  It is a condition of a manufacturer's licence that the licensee affix to each container of liquor sold a warning label that cautions women who are pregnant that the consumption of alcohol during pregnancy is the cause of Fetal Alcohol Spectrum Disorder.

   4.  Subsection 62 (1) of the Act is amended by adding the following paragraph:

10.3 governing the information to be included on a warning label mentioned in subsections 12 (2.1) and 22 (3.1);

Liquor Control Act

   5.  The Liquor Control Act is amended by adding the following section:

Duty of Board to label

   3.2  The Board shall only permit liquor to be sold in a government store if the container in which the liquor is sold has a warning label affixed to it setting out the prescribed information that cautions women who are pregnant that the consumption of alcohol during pregnancy is the cause of Fetal Alcohol Spectrum Disorder.

   6.  Subsection 8 (1) of the Act is amended by adding the following clause:

    (l)  governing the information to be included on a warning label mentioned in section 3.2.

Commencement and Short Title

Commencement

   7.  (1)  Subject to subsection (2), this Act comes into force on the day it receives Royal Assent. 

   (2)  Sections 1 to 6 come into force three months after the day this Act receives Royal Assent.

Short title

   8.  The short title of this Act is the Liquor Licence Statute Law Amendment Act (Liquor Labels), 2007.

 

EXPLANATORY NOTE

The Bill amends the Liquor Licence Act and the Liquor Control Act to require sellers and manufacturers to affix a warning label to containers of liquor, cautioning pregnant women about the risks of alcohol consumption.
