An Act to amend the Labour Relations Act, 1995 with respect to bargaining units in certified trades

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Section 128.1 of the Labour Relations Act, 1995 is amended by adding the following subsection:

Representation vote for certified trades

   (13.1)  For the purposes of this section, if a bargaining unit consists of employees who work in a certified trade under the Trades Qualification and Apprenticeship Act, an employee who is not the holder of a subsisting certificate of qualification for the trade or apprenticeship in the trade,

  (a)  shall not take part in the representation vote; and

  (b)  shall not be considered in the Board's determination of the percentage of employees in the bargaining unit who are members of the bargaining unit.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Labour Relations Amendment Act (Certified Trades), 2007.

 

EXPLANATORY NOTE

The Bill amends the Labour Relations Act, 1995, to restrict who may take part in a representation vote where the bargaining unit consists of employees who work in a certified trade under the Trades Qualification and Apprenticeship Act.
