An Act respecting the City of Ottawa

Preamble

The council of the City of Ottawa has applied for special legislation with respect to the composition and powers of a licence committee.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  Section 18 of the City of Ottawa Act (Consolidation of Special Acts), 2001 is repealed and the following substituted:

Licence committee

18.  (1)  A licence committee may be established by city council, to be composed of at least five and not more than seven persons each of whom is,

(a) a resident of the city;

(b) a Canadian citizen; and

(c) at least 18 years of age.

Appointment

(2)  The members of the licence committee are to be appointed by city council for a term not exceeding the term of city council.

Quorum

(3)  The quorum for a meeting of the licence committee may be established by by-law.

Transition

(4)  The licence committee, as it exists immediately before the City of Ottawa Act (Licence Committee), 2004 receives Royal Assent, shall be deemed to comply with this section as re-enacted by that Act for one year after the day on which that Act receives Royal Assent; the persons who are members of the committee immediately before that Act receives Royal Assent continue in office until their successors are appointed under this section.

Powers of licence committee

18.1  Despite any general or special Act, where city council is authorized to pass by-laws for licensing, regulating or governing any business or the person carrying on or engaged in the business, the licence committee established under section 18 is authorized, subject to the Statutory Powers Procedure Act, to suspend or revoke any such licence or to impose conditions as a requirement of obtaining, continuing to hold or renewing such a licence, including special conditions.

Commencement

2.  This Act comes into force on the day it receives Royal Assent.

Short title

3.  The short title of this Act is the City of Ottawa Act (Licence Committee), 2004.
