An Act to amend the
Ontario Lottery and
Gaming Corporation Act, 1999

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  Section 12 of the Ontario Lottery and Gaming Corporation Act, 1999 is amended by adding the following subsections:

Moratorium

(2)  Despite subsection (1), on or after the day on which this subsection comes into force, the Corporation shall not authorize the establishment of a gaming premises, but a gaming premises that the Corporation has authorized under that subsection before that day may be established.

Same, expansion

(3)  On or after the day on which this subsection comes into force, no gaming premises shall expand its operations.

Inquiry

(4)  Under the Public Inquiries Act, the Lieutenant Governor in Council shall appoint a commission to conduct an inquiry to study the social effect that the playing of games of chance has on the public.

Report

(5)  The commission shall make a written report to the Lieutenant Governor in Council on its findings in conducting the inquiry.

Public inspection

(6)  On receiving the report, the Lieutenant Governor in Council shall make it available for inspection by the public.

Commencement

2.  This Act comes into force on the day it receives Royal Assent.

Short title

3.  The short title of this Act is the Ontario Lottery and Gaming Corporation Amendment Act, 2004.

EXPLANATORY NOTE

The Bill amends the Ontario Lottery and Gaming Corporation Act, 1999 to prohibit the Ontario Lottery and Gaming Corporation from authorizing the establishment of any gaming premises on or after the day on which the Bill comes into force and to prohibit any gaming premises from expanding its operations on or after that day.

The Lieutenant Governor in Council is required to appoint a commission under the Public Inquiries Act to conduct an inquiry to study the social effect that the playing of games of chance has on the public. The commission is required to make a report to the Lieutenant Governor in Council on its findings in conducting the inquiry. The public is entitled to inspect the report.
