An Act to amend the
Dental Hygiene Act, 1991

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  Subsection 5 (1) of the Dental Hygiene Act, 1991 is repealed and the following substituted:

Additional requirements for authorized acts

(1)  A member shall not perform a procedure under the authority of paragraph 2 of section 4 unless the procedure is ordered by a member of the Royal College of Dental Surgeons of Ontario.

Commencement

2.  This Act comes into force on the day it receives Royal Assent.

Short title

3.  The short title of this Act is the Dental Hygiene Amendment Act, 2004.

EXPLANATORY NOTE

Currently, subsection 5 (1) of the Dental Hygiene Act, 1991 prohibits dental hygienists from carrying out the authorized acts of scaling teeth or root planing, including curetting of surrounding tissue, unless the procedures are ordered by a member of the Royal College of Dental Surgeons of Ontario. The purpose of the Bill is to permit dental hygienists to perform those procedures without such an order.
