An Act to amend the
Retail Sales Tax Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  (1)  Subparagraph 1 i of subsection 7 (1) of the Retail Sales Tax Act is amended by striking out "four dollars" and substituting "$6".

(2)  Subparagraph 1 ii of subsection 7 (1) of the Act is amended by striking out "four dollars" and substituting "$6".

(3)  Subparagraph 1.1 iii of subsection 7 (1) of the Act, as enacted by the Statutes of Ontario, 2002, chapter 8, Schedule J, section 2, is amended by striking out "$4" and substituting "$6".

Commencement

2.  This Act comes into force on the day it receives Royal Assent.

Short title

3.  The short title of this Act is the Retail Sales Tax Amendment Act, 2004.

EXPLANATORY NOTE

The Bill amends the Retail Sales Tax Act to expand the exemption from retail sales tax for prepared food products from an eating establishment. At present, those food products are exempt from tax if they are sold for $4 or less. The Bill raises the price for the exemption to $6 or less.
