An Act to amend various Acts
in respect of the reporting of
missing persons from care facilities

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Amendment to the Charitable Institutions Act

1.  The Charitable Institutions Act is amended by adding the following section:

Compulsory reporting of missing residents

9.2.1  Every service agreement shall be deemed to contain a provision requiring the administrator of a charitable institution to notify police immediately where the administrator has reasonable grounds for believing that a resident has gone missing from the charitable institution.

Amendment to the Developmental Services Act

2.  The Developmental Services Act is amended by adding the following section:

Compulsory reporting of missing residents

10.  The administrator of a facility shall immediately notify police where the administrator has reasonable grounds for believing that a resident has gone missing from the facility.

Amendment to the Homes for the Aged and Rest Homes Act

3.  The Homes for the Aged and Rest Homes Act is amended by adding the following section:

Compulsory reporting of missing residents

30.0.1  The administrator of a home shall immediately notify police where the administrator has reasonable grounds for believing that a resident has gone missing from the home.

Amendment to the Nursing Homes Act

4.  The Nursing Homes Act is amended by adding the following section:

Compulsory reporting of missing residents

20.15.1  Every service agreement shall be deemed to contain a provision requiring the administrator of a nursing home to notify police immediately where the administrator has reasonable grounds for believing that a resident has gone missing from the nursing home.

Commencement

5.  This Act comes into force on the day it receives Royal Assent.

Short title

6.  The short title of this Act is the Missing Persons Reporting Act, 2005.

EXPLANATORY NOTE

The Bill amends the Charitable Institutions Act, the Developmental Services Act, the Homes for the Aged and Rest Homes Act and the Nursing Homes Act to ensure that police are immediately notified when a resident of a care facility operated under one of those Acts goes missing.
