An Act to amend the Freedom of Information and Protection of Privacy Act respecting the Speaker of the Assembly

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1.  Subsection 1.1 (1) of the Freedom of Information and Protection of Privacy Act is repealed and the following substituted:

Limited application re Assembly

(1)  This Act applies to the Assembly as follows:

1. With respect to records of reviewable expenses of the Opposition leaders and the persons employed in their offices and in respect of the personal information contained in those records.

2. With respect to any records that the Speaker has in his or her custody or control and in respect of the personal information contained in those records, including, but not limited to,

i. records of expenses of the Speaker, the Speaker's office and persons employed by the Speaker, and

ii. records that the Speaker has in his or her custody or control by virtue of his or her role as chair of the Office of the Assembly, chair of the Board of Internal Economy or by virtue of any duty or function of the Speaker referred to in sections 76 to 108 of the Legislative Assembly Act.

(1.1)  Despite paragraph 2 of subsection (1), this Act does not apply to records that the Speaker has in his or her custody or control that pertain to his or her role as a member of the Assembly.

Commencement

2.  This Act comes into force on the day it receives Royal Assent.

Short title

3.  The short title of this Act is the Freedom of Information and Protection of Privacy Amendment Act (Speaker of the Assembly), 2005.

EXPLANATORY NOTE

The Bill amends the Freedom of Information and Protection of Privacy Act to provide that the Act applies with respect to records in the custody of the Speaker with the exception of records that pertain to his or her role as a member of the Assembly.
