An Act respecting the
Municipality of Chatham-Kent

Preamble

The Corporation of the Municipality of Chatham-Kent has applied for special legislation to continue in force until December 31, 2004 certain by-laws and resolutions that, under a restructuring order made under subsection 25.3 (13) of the Municipal Act, would otherwise cease to be in force on December 31, 2002.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Definitions

1. In this Act,

"former municipality" has the same meaning as in the restructuring order;

"restructuring order" means the order amalgamating the former municipalities into The Corporation of the Municipality of Chatham-Kent, effective January 1, 1998 that was made on April 28, 1997 under subsection 25.3 (13) of the Municipal Act, as the order appears in The Ontario Gazette dated April 17, 1997.

By-laws and resolutions of former municipalities

2. (1) Every by-law and resolution of a former municipality that is continued in force until December 31, 2002 by virtue of clause 11 (1) (b) of the restructuring order is hereby continued in force until the earlier of,

(a) the date the by-law or resolution is amended or repealed; or

(b) December 31, 2004.

(2) Subsection (1) applies despite subsection 11 (1) of the restructuring order.

By-laws and resolutions re water

3. (1) Every by-law and resolution of a former municipality and of a public utilities commission of a former municipality dissolved under section 21 of the restructuring order that relates to the production, treatment, distribution and supply of water that is continued in force until December 31, 2002 by virtue of clause 24 (2) (b) of the restructuring order is hereby continued in force until the earlier of,

(a) the date the by-law or resolution is amended or repealed; or

(b) December 31, 2004.

Same

(2) Subsection (1) applies despite subsection 24 (2) of the restructuring order.

Commencement

4. This Act comes into force on the day it receives Royal Assent.

Short title

5. The short title of this Act is the Municipality of Chatham-Kent Act, 2002.
