An Act to amend the
Child and Family Services Act
to allow school boards and
police services access
to the child abuse register

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. (1) Section 75 of the Child and Family Services Act, as amended by the Statutes of Ontario, 1994, chapter 27, section 43 and 1999, chapter 2, section 27, is amended by adding the following subsection:

Access by school board to protect children

(7.1) A person who is an employee of a school board and who is authorized by the school board to do so or a police officer who is assisting a school board may inspect, remove and disclose information in the register where the information may be used to assist in the protection of the children under the charge of the school board.

(2) Subsection 75 (8) of the Act is amended by adding "or (7.1)" after "subsection (7)" in the portion after clause (b).

(3) Subsection 75 (9) of the Act is amended by striking out "(7)" and substituting "(7), (7.1)".

(4) Section 75 of the Act, as amended by the Statutes of Ontario, 1994, chapter 27, section 43 and 1999, chapter 2, section 27, is amended by adding the following subsection:

Definition

(15) In this section,

"school board" means a board as defined in subsection 1 (1) of the Education Act.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the Child and Family Services Amendment Act (Access to Child Abuse Register), 2002.

EXPLANATORY NOTE

The Bill amends the Child and Family Services Act to allow school boards and police services working with them access to the child abuse register to assist in protecting children under the charge of the school board.
