An Act to amend the
Electricity Act, 1998
by making the corporations
created under it subject to the
Freedom of Information
and Protection of Privacy Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. The Electricity Act, 1998 is amended by adding the following section:

Application of Act

6.1 Despite section 6, the IMO is deemed to be an institution for the purposes of the Freedom of Information and Protection of Privacy Act and that Act applies to the IMO.

2. The Act is amended by adding the following section:

Application of Act

51.1 (1) Despite section 51, the Generation Corporation and the Services Corporation and their subsidiaries are deemed to be institutions for the purposes of the Freedom of Information and Protection of Privacy Act and that Act applies to them.

(2) The Generation Corporation and the Services Corporation and their subsidiaries are deemed to be part of the public sector for the purposes of the Public Sector Salary Disclosure Act, 1996 and that Act applies to them.

3. Section 83 of the Act is amended by adding the following subsection:

(2) The Financial Corporation and its subsidiaries are deemed to be institutions for the purposes of the Freedom of Information and Protection of Privacy Act and that Act applies to them.

Commencement

4. This Act comes into force on the day it receives Royal Assent.

Short title

5. The short title of this Act is the Electricity Amendment Act (Hydro Salary Disclosure), 2002.

EXPLANATORY NOTE

The Bill amends the Electricity Act, 1998 by deeming each corporation created under that Act an institution for purposes of the Freedom of Information and Protection of Privacy Act and making the Freedom of Information and Protection of Privacy Act applicable to such corporations. The Bill also makes the Public Sector Salary Disclosure Act, 1996 applicable to the Generation Corporation, the Services Corporation and to their subsidiaries.
