An Act to amend
the Health Protection and
Promotion Act to require
that a certified food handler
be present at all times during
the operation of a food premise

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. (1) Subsection 16 (3) of the Health Protection and Promotion Act is amended by adding "Subject to subsection (3.1)" at the beginning.

(2) Section 16 of the Act is amended by adding the following subsections:

Certified food handler to be present

(3.1) Every person who operates a food premise shall ensure that at all times during its operation a person who is a certified food handler is employed and is present at the food premise.

Certification

(3.2) For purposes of subsection (3.1), a person who holds a valid certificate in food handling issued through a board of health is a certified food handler.

Commencement

2. This Act comes into force on July 1, 2003.

Short title

3. The short title of this Act is the Health Protection and Promotion Amendment Act (Food Handlers), 2002.

EXPLANATORY NOTE

The Bill amends the Health Protection and Promotion Act by requiring that at every food premise at least one person certified in food handling be employed and present at all times during the operation of the food premise.
