An Act to amend the
Ontario Educational
Communications Authority Act
to create separate
French language and
English language sections

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. (1) Subsection 2 (2) of the Ontario Educational Communications Authority Act, as amended by the Statutes of Ontario, 1999, chapter 12, Schedule Q, section 1, is amended by striking out "13" and substituting "15".

(2) Section 2 of the Act, as amended by the Statutes of Ontario, 1997, chapter 26, Schedule and 1999, chapter 12, Schedule Q, section 1, is amended by adding the following subsections:

(2.1) The Authority shall consist of two sections of not more than seven members each, with the Chair being a member of each section.

(2.2) One section of the Authority shall be a French language section of the Authority and the other section shall be an English language section.

(3.1) The Lieutenant Governor in Council shall appoint French-speaking members to the French language section of the Authority

Transition

(4.1) Within 12 months after the day the Ontario Educational Communications Authority Amendment Act, 2002 receives Royal Assent, the Lieutenant Governor in Council shall designate which members of the Authority are members of the French language section and which members are members of the English language section.

(3) Subsection 2 (5) of the Act is repealed and the following substituted:

Chair and Vice-Chairs of the Board

(5) The Chair of the Authority shall be the Chair of the Board, and the Lieutenant Governor in Council shall from time to time designate one of the members of the French language section as Vice-Chair of the Board and one of the members of the English language section as Vice-Chair of the Board and shall prescribe their duties.

(4) Subsection 2 (7) of the Act, as amended by the Statutes of Ontario, 1999, chapter 12, Schedule Q, section 1, is repealed and the following substituted:

Quorum

(7) A majority of the directors constitute a quorum for meetings of the Board and a majority of the directors designated for each section of the Board constitute a quorum for meetings of the section.

2. The Act is amended by adding the following section:

Jurisdiction

3.1 (1) The French language section of the Board has exclusive jurisdiction over the following objects of the Authority:

1. Initiating, acquiring, producing, distributing, exhibiting or otherwise dealing in French language programs and French language materials in the educational broadcasting and communications fields.

2. Engaging in research in those fields of activity consistent with its jurisdiction over activities listed in paragraph 1.

3. Discharging such other duties as relating to French language educational broadcasting and French language communications as the section considers to be incidental or conducive to the attainment of the objects mentioned in paragraphs 1 and 2.

4. On and after the day on which clause 3 (d) is proclaimed in force, establishing and administering distance French language education programs.

(2) The English language section of the Board has exclusive jurisdiction over the following objects of the Authority:

1. Initiating, acquiring, producing, distributing, exhibiting or otherwise dealing in English language programs and English language materials in the educational broadcasting and communications fields.

2. Engaging in research in those fields of activity consistent with its jurisdiction over activities listed in paragraph 1.

3. Discharging such other duties as relating to English language educational broadcasting and English language communications as the section considers to be incidental or conducive to the attainment of the objects mentioned in paragraphs 1 and 2.

4. On and after the day on which clause 3 (d) is proclaimed in force, establishing and administering distance English language education programs.

Common jurisdiction

(3) In respect of any object not referred to in subsection (1) or (2), the Board as a whole has jurisdiction and may deal with the object as a whole or in such manner as the Board considers appropriate, including by referring particular matters to one section or the other.

3. Section 7 of the Act is amended by adding the following subsection:

Powers of section

(1.1) In respect of the objects that are in the exclusive jurisdiction of a section of the Board as provided in section 3.1, the section has the powers listed in subsection (1) in the exercise of its exclusive jurisdiction over its objects.

Commencement

4. This Act comes into force on the day it receives Royal Assent.

Short title

5. The short title of this Act is the Ontario Educational Communications Authority Amendment Act, 2002.

EXPLANATORY NOTE

The Bill amends the Ontario Educational Communications Authority Act to require that there be a French language section of the Board, which shall be composed of French-speaking members and an English language section of the Board. The French language section is given exclusive jurisdiction over French language programs and French language materials in the educational broadcasting and communications fields.
