An Act to provide
for the election of members
of the board of Welland Hydro

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Definition

1. In this Act,

"Welland Hydro" means the corporation established under the Business Corporations Act as the successor to the commission known as the Welland Hydro-Electric Commission in English and Commission hydroélectrique de Welland in French, which was continued by Part III of the Regional Municipality of Niagara Act, and includes any successor to that corporation.

Board of directors

2. Despite any other Act, law or document, the board of directors of Welland Hydro consists of:

1. The mayor of the City of Welland.

2. Four members elected in accordance with the Municipal Elections Act, 1996.

Transitional

3. (1) The first election of the members mentioned in paragraph 2 of section 2 shall take place at the regular municipal election held under the authority of subsection 4 (1) of the Municipal Elections Act, 1996 in November, 2003.

Same

(2) Until members of the board of directors who are elected as provided for in subsection (1) take office, the members of the board of directors shall be those persons who would have been directors if it had not been for this Act.

Regulations

4. The Lieutenant Governor in Council may make regulations,

(a) to expedite the election of directors under this Act, including modifying the application of the Municipal Elections Act, 1996 to such elections;

(b) generally for carrying out the purposes and provisions of this Act.

Commencement

5. This Act comes into force on the day it receives Royal Assent.

Short title

6. The short title of this Act is the Welland Hydro Elections Act, 2002.

EXPLANATORY NOTE

The Bill provides that the members of the board of directors of Welland Hydro are the mayor of the City of Welland and four elected directors.
