An Act to ban
drive-through restaurants
in the former cities
of Toronto and York and the
former Borough of East York

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Issuing permit prohibited

1. (1) The City of Toronto shall not issue a building permit for the construction of any drive-through restaurants within the area comprised of the portion of the City of Toronto that on December 31, 1997 was located in the geographic area of the former City of Toronto, the former City of York and the former Borough of East York.

(2) The City of Toronto shall not issue a building permit for an addition to or renovation of a restaurant that would have the effect of creating a drive-through restaurant in the geographic area described in subsection (1).

Conflicts

(3) If there is a conflict between this Act and any legislation or by-law affected by this Act, this Act prevails.

Definition

(4) In this section,

"drive-through restaurant" means any restaurant that includes an operation where patrons may purchase a take-out meal while remaining seated inside a motor vehicle that is lined up in a designated service lane.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the Ban on Drive-Through Restaurants in Toronto Act, 2002.

EXPLANATORY NOTE

The Bill prohibits the issuing of building permits for constructing drive-through restaurants in the former cities of Toronto and York and the former Borough of East York.
