An Act to increase teacher representation at the Ontario College of Teachers and to make other amendments to the Ontario College of Teachers Act, 1996

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. Subsection 4 (2) of the Ontario College of Teachers Act, 1996 is repealed and the following substituted:

Composition of Council

(2) The Council shall be composed of,

(a)24 persons who are members of the College and who are elected by the members of the College in accordance with the regulations; and

(b)8 persons who are appointed by the Lieutenant Governor in Council in accordance with the regulations.

2. The Act is amended by adding the following section:

Quorum of Council

4.1 The quorum of the Council shall be as prescribed by the regulations but there is no quorum unless a majority of the persons elected to the Council under clause 4 (2) (a) are present.

3. The Act is amended by adding the following section:

Chair of Council

4.2 The Council shall elect one of its members to be the chair of the Council.

4. Subsection 17 (1) of the Act is repealed and the following substituted:

Majority on committees

(1) A majority of the members of each committee established by the Council shall be persons elected to the Council under clause 4 (2) (a).

5. The Act is amended by adding the following section:

Quorum

17.1 The quorum of a committee shall be as prescribed by the regulations or as provided in the by-laws in the case of a committee that is not required by this Act but there is no quorum unless a majority of the members of the committee who are elected to the Council under clause 4 (2) (a) are present.

Commencement

6. This Act comes into force on a day to be named by proclamation of the Lieutenant Governor.

Short title

7. The short title of this Act is the Ontario College of Teachers Amendment Act, 1999.

EXPLANATORY NOTE

This Bill amends the Ontario College of Teachers Act, 1996.

The composition of the Council of the College is changed increasing the proportion of elected members of the College so that they will make up 75 per cent of the Council. (See subsection 4 (2) of the Act.)

Provisions are added to provide that the Council or a committee will not have a quorum unless a majority of the elected Council members are present. (See sections 4.1 and 17.1 of the Act.)

The Council will be required to elect one of its members to be the chair. (See section 4.2 of the Act.)

All committees will be required to have a majority of elected Council members. (See subsection 17 (1) of the Act.)
