An Act respecting Institute for Advanced Judaic Studies Preamble

The board of governors of the Institute for Advanced Talmudic Study has applied for special legislation permitting it to grant degrees in the field of religious studies and research in higher Jewish learning under the name Institute for Advanced Judaic Studies. The applicant represents that it was incorporated by letters patent dated October 9, 1970 and that it has maintained, since 1970, an institution of higher learning in theology, religious education, scholarship and research.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows: Definitions

1. In this Act,

"board" means the board of governors of the Institute;

"Institute" means Institute for Advanced Judaic Studies. Corporation continued

2. (1) The board of governors of the Institute for Advanced Talmudic Study is continued as a corporation without share capital under the name Institute for Advanced Judaic Studies. Letters patent revoked

(2) The letters patent and supplementary letters patent of the Institute for Advanced Talmudic Study are revoked, but the revocation does not affect the rights or obligations of the Institute or any by-law, resolution or appointment of the Institute, except to the extent that they are inconsistent with this Act. (3) The Institute shall be deemed to be a corporation incorporated by a special Act. Objects

3. The objects of the Institute are,

(a) to provide post-secondary training programs in religious education and in research in higher Jewish learning for rabbis, teachers and educators;

(b) to develop the devotional and spiritual life of its students;

(c) to encourage its students to develop a mastery of the content of the Bible, Judaic theology, talmudic law and legal codes. Power to grant degrees

4. The Institute may grant diplomas and certificates and the degrees of Bachelor of Judaics, Bachelor of Talmudic Law, Master of Judaics, Master of Talmudic Law, Doctor of Philosophy in Judaics and Doctor of Philosophy in Talmudic Law. Board

5. (1) The affairs of the Institute shall be managed by its board. Composition

(2) The board is composed of,

(a) the president of the Institute;

(b) the vice-president of the Institute;

(c) five people elected from among the members of the Institute; and

(d) two people elected by the remaining members of the board. Term of office

(3) The term of office for members elected under clauses (2) (c) and (d) is two years or until their successors are elected. Election

(4) The board shall by by-law determine the manner and procedure for the election of the members to be elected under clauses (2) (c) and (d). Same

(5) The board may by by-law provide for the election and retirement in rotation of the members elected under clause (2) (c). Citizenship status

(6) A majority of the members of the board must be Canadian citizens or permanent residents within the meaning of the Immigration Act (Canada). Quorum

(7) A majority of the members of the board constitutes a quorum unless the by-laws provide otherwise, but the by-laws shall not provide for a quorum of less than two-fifths of the members of the board. Members

(8) The members and officers of the board, effective on the day this Act receives Royal Assent and for a term of two years or until their successors are elected, are J. Hirschman, president, S. Miller, vice-president, J. Abraham, J. D. Kaplan, P. Moldaver, J. Ostroff, Dr. J. Posen, I. Schon and S. Shatz. Powers of the board

6. (1) The board shall govern the Institute and manage its affairs and may exercise such powers as are necessary to carry out its duties. Same

(2) Without limiting the generality of the foregoing, the board may,

(a) adopt a doctrinal statement for the Institute;

(b) establish and terminate programs and courses of study;

(c) appoint, promote, grant leave to, suspend and remove members of the faculty;

(d) appoint, promote, suspend and remove the officers of the Institute;

(e) establish and collect fees and charges for tuition and for services of any kind offered by the Institute;

(f) invest all money of the Institute that is not immediately required to be expended;

(g) federate or affiliate the Institute with any other institution of higher learning;

(h) appoint committees and delegate to them the power and authority to act for the board on any matter, as long as a majority of the members of the committee are members of the board;

(i) enact by-laws for the conduct of its affairs. President

7. The president of the Institute is the dean of the Institute and the presiding officer at board meetings. Academic council

8. The academic council of the Institute is established and is composed of,

(a) the president of the Institute;

(b) the vice-president of the Institute;

(c) such number of members of the faculty, not to exceed three, as is determined by the president and vice-president; and

(d) three members of the board, other than the president and the vice-president, appointed by the board. Powers of the academic council

9. The academic council shall manage the academic affairs of the Institute and may,

(a) recommend to the board the establishment and termination of programs and courses of study;

(b) determine the curricula of programs and courses of study;

(c) determine the standards of admission to and continued registration in the Institute;

(d) determine qualifications for graduation and for conferring diplomas, certificates and degrees;

(e) determine all matters related to examinations and the appointment of examiners;

(f) award fellowships, scholarships, bursaries, medals, prizes and other marks of academic achievement;

(g) appoint committees and delegate to them the power and authority to act for it on any matter set out in clauses (a) to (f), as long as a majority of the members of the committee are members of the academic council or the faculty;

(h) determine the number of faculty members to be elected to the academic council under clause 8 (c), and determine the terms of office for each such member, such term not to exceed three years;

(i) determine all other matters related to the election of members of the academic council. Presiding officer - academic council

10. The president of the Institute is the presiding officer at academic council meetings. By-laws available

11. The board shall keep the by-laws of the board and of the academic council available for examination by interested persons during normal office hours. Commencement

12. This Act comes into force on the day it receives Royal Assent. Short title

13. The short title of this Act is the Institute for Advanced Judaic Studies Act, 1997.
