An Act respecting the City of Hamilton

Preamble

The Corporation of the City of Hamilton, referred to in this Act as the Corporation, has applied for special legislation to permit it to make loans and grants to tenants as part of its community improvement plan.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Grants and loans to tenants for community improvement plan

1. For the purpose of carrying out a community improvement plan adopted under section 28 of the Planning Act, and in addition to the power in subsection 28 (7) of that Act to make grants or loans to property owners, the council of the Corporation may make grants or loans to the tenants of lands and buildings within the community improvement project area to pay for the whole or any part of the cost of rehabilitating such lands and buildings in conformity with the community improvement plan.

Application of ss. 28 (7) of the Planning Act

2. (1) A grant or loan made under section 1 shall be deemed to have been made under subsection 28 (7) of the Planning Act.

(2) The community improvement plan adopted by the council of the Corporation applies with necessary modifications to a grant or loan made under section 1 as if it were a grant or loan made under subsection 28 (7) of the Planning Act.

(3) The provisions of the Planning Act that apply to a grant or loan made under subsection 28 (7) of that Act apply with necessary modifications to a grant or loan made under section 1.

Commencement

3. This Act comes into force on the day it receives Royal Assent.

Short title

4. The short title of this Act is the City of Hamilton Act, 1997.
